RESOLUTION NO. 23-0171
A RESOLUTION OF THE MANHATTAN BEACH CITY COUNCIL IN
SUPPORT OF THE PROPOSED STORM DRAIN FEE INCREASE
RECITALS
WHEREAS, the cost of operating the City’s aging storm drain system has vastly increased since the City’s storm drain fee was originally established in 1996.
WHEREAS, Storm drain fee revenues are currently projected to be approximately $350,000 per year, with estimated average operating expenditures of approximately $2 .2 million per year , including an estimated $8.4 million i n repair and replacement projects needed over the next six years. The City also receives an allocation from Los Angeles County’s Measure W Safe Clean Water Program of approximately $410,000 per year.
WHEREAS, revenues from the City’s existing storm drain fee, which has not been increased since its adoption in 1996, are not sufficient to fund the ongoing operations, maintenance, repairs and capital improvements to the City’s storm drain system.
WHEREAS, the City’s Stormwater Fund has been operating at a def icit and has required General Fund subsidies since Fiscal Year 2015-2016 (in the last five years, the General Fund has provided over $6 million in subsidies). If the storm drain fee is not increased, the Stormwater Fund is currently projected, over the ne xt six years, to need approximately $11.6 million of General Fund subsidies, with $8.4 million attributed to capital projects, which takes away funding for other general City services.
WHEREAS, in accordance with Article XIIID of the California Constitutio n (“Proposition 218”) and the Proposition 218 Omnibus Implementation Act (Government Code Section 53750, et seq.), on November 7, 2023, the City held a duly noticed public hearing on the matter of a proposed increase to the City’s existing storm drain fee (“Proposed Increase”), at which time members of the public spoke. After public testimony was concluded, The City Clerk determined that there was no majority written protest against the Proposed Increase, and called for a special mailed ballot election for the purpose of submitting the Proposed Increase to a vote of the owners of parcels that are subject to the Proposed Increase.
WHEREAS, ballots for the Proposed Increase are due by 5:00 p.m. on January 17, 2024.
NOW, THEREFORE, THE MANHATTAN BEACH CITY C OUNCIL HEREBY FINDS, DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The Manhattan Beach City Council supports voter approval of the proposed storm drain fee increase as a critical way to raise dedicated revenue for the City’ aging storm drain system.
2 SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
ADOPTED on December 19, 2023.
