RESOLUTION NO. 24-0005
A RESOLUTION OF THE MANHATTAN BEACH CITY
COUNCIL AUTHORIZING THE CITY MANAGER TO
EXECUTE BALLOTS REGARDING PROPOSED STORM
DRAIN FEE INCREASE ON BEHALF OF THE CITY AS
RECORD OWNER OF PARCELS IN THE CITY
WHEREAS, revenues from the City’s existing storm drain fee, which has not been increased since its adoption in 1996, are not sufficient to fund the ongoing operations, maintenance, repairs and capital improvements to the City’s storm drain system.
WHEREAS, the City’s Stormwater Fund has been operating at a deficit and has required General Fund subsidies since Fiscal Year 2015-2016 (in the last five years, the General Fund has provided over $6 million in subsidies). If the storm drain fee is not increased, the Stormwater Fund is currently projected, over the next six years, to need approximately $11.6 million of General Fund subsidies, with $8.4 million attributed to capital projects, which takes away funding for other general City services.
WHEREAS, in acco rdance with Article XIIID of the California Constitution (“Proposition 218”) and the Proposition 218 Omnibus Implementation Act (Government Code Section 53750, et seq.), on November 7, 2023, the City held a duly noticed public hearing on the matter of a pr oposed increase to the City’s existing storm drain fee (“Proposed Increase”), and determined that there was no majority written protest against the Proposed Increase, and called for a special mailed ballot election for the purpose of submitting the Proposed Increase to a vote of the owners of parcels that are subject to the Proposed Increase.
WHEREAS, on December 19, 2023, the City Council adopted Resolution No. 23 - 017 entitled “Resolution of the Manhattan Beach City Council in Support of the Proposed Storm Drain Fee Increase.”
WHEREAS, ballots for the Proposed Increase are due by 5:00 p.m. on January 17, 2024.
WHEREAS, the City is record owner of several parcels of property in the City and desires to delegate authority to the City Manager to execute the s torm drain ballots on behalf of the City in accordance with the City’s position as stated in Resolution No. 23 - 017.
NOW, THEREFORE, THE MANHATTAN BEACH CITY COUNCIL HEREBY FINDS, DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The Manhattan Beach City Council hereby delegates authority to the City Manager to execute the City’s storm drain ballots in accordance with the City’s position as stated in Resolution No. 23-017, as a critical way to raise dedicated revenue for the City’s aging storm drain system.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
