2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MANHATTAN BEACH, CALIFORNIA,
3 (MEMBERSHIP) FOR THE PARKING AND PUBLIC IMPROVEMENTS
COMMISSION CLARIFYING THE DEFINITION OF "BUSINESS
4 COMMUNITY MEMBER" FOR SEAT NOS. 2 AND 4
5 WHEREAS, pursuant to Chapter 2.44 of the City of Manhattan Beach Municipal Code, a Parking and Public Improvements Commission has been created and established; and WHEREAS, at the City Council Meeting of October 16, 2007, the City Council requested that Section 3 (Membership) for the Parking and Public Improvements Commission be 7 defined that the "Business Community Member" be from a "bricks and mortar" type of business. 8 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MANHATTAN BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
That Section 3 of Resolution No. 5366, passed and adopted on the 3" day of 10 February, 1998 be amended by Resolution No. 6137 as follows:
11 12 SECTION 1. To amend Section 3 (Membership) of Resolution No. 5366 to read as follows:
13 MEMBERSHIP
(a) The Commission shall be composed of five (5) qualified electors and residents 14 of the City of Manhattan Beach, appointed and subject to removal by a majority of the City Council. 15 (b) Three (3) of the members shall be selected at-large and two (2) of the members shall be selected from the business community (owning and/or operating businesses 16 located in the City of Manhattan Beach) excluding home based businesses. 17 SECTION 2. That each and every provision of Resolution No. 5366 which is not being amended by or inconsistent with the foregoing shall remain in full force and effect. 18 SECTION 3. The City Clerk shall make this Resolution reasonably available for public 19 inspection within thirty (30) days of the date this Resolution is adopted. 20 SECTION 4. The City Clerk shall certify to the adoption of this Resolution and thenceforth and thereafter the same shall be in full force and effect. 21 PASSED, APPROVED and ADOPTED this 6 day of May, 2008. 22 Ayes: Cohen, Ward, Tell, Montgomery and Mayor Aldinger. 23 Noes: None.
