A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MANHATTAN BEACH, CALIFORNIA, ACCEPTING A RIGHT
OF ENTRY AND ACCESS AGREE MENT AT 1360
VOORHEES AVENUE FOR THE VOORHEES AVENUE
SEWER LIFT STATION IMPROVEMENTS PROJECT
THE MANHATTAN BEACH CITY COUNCIL HEREBY RESOLVES AS
FOLLOWS:
SECTION 1. The City of Manhattan Beach (“City”) has undertaken the Voorhees Avenue Sewer Lift Station Improvements Project (“Project”) to provide upgrades to the existing sewer lift station, such as new adequate emergency storage wet well, reintegration of the existing station dry vault structure, and installation of new mechanical and electrical equipment including a new emergency generator, locate d at the corner of Voorhees Avenue and Row ell Avenue directly adjacent to the 1360 Voorhees Avenue property in the City (“Property”), which is owned by Scott Schumacher (“Owner”) . In connection with this Project, the City requires the Right of Entry and Access Agreement, in and to a portion of the Property.

SECTION 2. Owner authorized and executed the Right of Entry and Access Agreement that grants construction access for the duration of the Project to the City. True and correct cop ies of the Right of Entry and Access Agree ment are attached hereto as Attachment A and are hereby incorporated by this reference.
SECTION 3. The City Council hereby accepts and consents to the conveyances of the above referenced Right of Entry and Access Agreement rights to the City for public purposes.
SECTION 4. The City Council hereby authorizes the City Manager and/or his or her designee to cause the City to accept the Owner conveyance of the above referenced Right of Entry and Access Agree ment rights on behalf of the City and to record said grant of rights to the City by executing the Right of Entry and Access Agreement with the Owner (Attachment A) and any other forms necessary to effectuate the acceptance and recordation of the Right of Entry and Access Agreement rights.
SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution.

This is to certify that the interest in real property conveyed by the deed or grant or agreement dated __________ from Owner Scott Schumacher of 1360 Voorhees Avenue, is hereby accepted by the undersigned agent on behalf of the City of Manhattan Beach pursuant to authority conferred by Resolution No. 24- 0072 of the City Council of the City of Manhattan Beach, adopted on June 18, 2024, and the grantee consents to the recordation thereof by it s duly authorized agent.
