Agenda Date: 3/4/2025
TO:

Honorable Mayor and Members of the City Council
THROUGH:

Talyn Mirzakhanian, City Manager
FROM:

Liza Tamura, City Clerk
Martha Alvarez, Assistant City Clerk
SUBJECT:

Consideration of City Council Assignments Appointing Councilmember Franklin and Councilmember Charelian to the KHHR Communities Network Committee (CNC) (No Budget Impact) (City Clerk Tamura).

APPROVE
_________________________________________________________ RECOMMENDATION:

Staff recommends that the City Council approve the appointment of Councilmember Franklin and Councilmember Charelian to the KHHR Communities Network Committee (CNC), as identified in the revised City Council Assignments document (attached).

FISCAL IMPLICATIONS:

There are no fiscal implications associated with the recommended action.

BACKGROUND:

It is the responsibility of each Mayor to review the standing list of City Council assignments to various government and community-related committees. Additionally, changes to the assignments can be made at the discretion of the Mayor. During the City Council Reorganization of December 17, 2024, Mayor Howorth approved the City Council assignments, which included the two newly elected City Councilmembers, Nina Trieu Tarnay and Steve S.

Charelian. At that time, KHHR Communities Network Committee (CNC) was not included in the list of assignments.

DISCUSSION:

City Manager Talyn Mirzakhanian received a letter from the City of Hawthorne regarding the KHHR Communities Network Committee (CNC), requesting to select two City Councilmembers

to be appointed to this committee or to relinquish the City’s seat.

At the request for Mayor Howorth, staff has prepared a revised version of the City Council assignments. This revision adds the KHHR Communities Network Committee (CNC) with Councilmember Franklin and Councilmember Charelian as the delegates. The revision to the assignments is attached for City Council consideration.

Staff recommends that the City Council approve the revision to the City Council Assignments.

Upon approval of the aforementioned revision, staff will update the City Council Assignments document.

PUBLIC OUTREACH:

After analysis, staff determined that public outreach was not required for this issue.

ENVIRONMENTAL REVIEW:

The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary.

LEGAL REVIEW:

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.

City Manager Talyn Mirzakhanian
City of Manhattan Beach
1400 Highland Avenue
Manhattan Beach, CA 90266

Dear City Manager,
I hope this message finds you in good spirits. I am reaching out on behalf of the KHHR Communities Network Committee (CNC) to discuss an important matter concerning the consistent attendance at our scheduled committee meetings. Active engagement from all member cities is vital for maintaining quorum and progressing initiatives that benefit our communities.

In accordance with Hawthorne Resolution No. 8509, which amends the membership composition of the KHHR Communities Network Committee and clarifies the elections and terms of the Chair and Vice-Chair, we encourage all member cities to ensure active representation to facilitate balanced decision-making and operational effectiveness.

It has come to our attention that the City of Manhattan Beach has not had representation at several CNC meetings. We understand that unforeseen circumstances or resource limitations may impact attendance.

Nevertheless, regular representation is essential to meet the responsibilities set forth in the resolution and to uphold the mission of the CNC.

To address this situation, we would appreciate your feedback on the following options:

1. Electing a New Representative : If the current representative is unable to fulfill their duties, we encourage your city to appoint a new delegate who can participate actively in CNC meetings.

2. Removing the City’s Seat: If your city prefers to relinquish its seat on the CNC, please inform us so that we can adjust the membership composition accordingly, which will aid in achieving quorum.

We greatly value your city's involvement and are dedicated to collaborating effectively to ensure the ongoing success of the CNC. Please communicate your city's preference no later than March 10, 2025.

Should you have any questions or need further information, feel f ree to reach out at (310) 349-2910 or email my assistant, Catherine Alcantara at [email protected] .

Thank you for your attention to this important issue and for your continued commitment to regional collaboration and community development.

Best regards,

Vontray Norris

Consideration of a Resolution Approving the Donation of Surplus Fire Equipment to El Camino College Fire Academy and Rio Hondo Fire Academy and Authorizing the City Manager to Execute Associated Agreements (No Budget Impact) (Interim Finance Director Jones and Fire Chief Lang).

ADOPT RESOLUTION NO. 25-0019
_________________________________________________________ RECOMMENDATION:

Staff recommends that the City Council consider adopting Resolution No. 25-0019 approving the donation of surplus fire equipment to the El Camino College Fire Academy and Rio Hondo Fire Academy and authorizing the City Manager to execute associated agreements.

FISCAL IMPLICATIONS:

The surplus fire equipment, including air packs, air bottles, regulators, and masks, has an estimated value between $10,000 - $14,000, which the City will forego by donating to these agencies.

BACKGROUND:

All of the requested fire equipment, air packs, air bottles, regulators, masks, etc., are nearing the end of their useful life and have been replaced according to National Fire Protection Association guidelines. As a result, these items have been removed from service. Standard procedure is to either auction or send to a scrap metal recycler for the best attainable value as required by the City’s Municipal Code, however, this requirement may be waived by the City

Council.

DISCUSSION:

Staff has received a request from the El Camino College Fire Academy Rio Hondo Fire Academy to donate used fire equipment for the academies’ use. In the past, the City has donated surplus property to this organization to support their training efforts.

In order to qualify for our entry level Firefighter testing, candidates must successfully graduate from a State certified fire academy prior to application. The majority of our newly hired employees come to us through these programs.

Our used equipment would be of great value to their training program, familiarizing students with the types of equipment used in municipal fire operations. While the City typically sells surplus property for the best attainable value, the City has also donated vehicles and equipment to other organizations in the past, including Manhattan Beach Unified School District, Community Emergency Response Team, Los Angeles County Fire Lifeguards, and sister city, Santa Rosalia, Mexico. These organizations are typically either another public agency or a community organization with limited funding sources, where surplus equipment has great value.

Municipal Code Section 2.36.180 requires that surplus property be disposed of for the best attainable value, which is typically obtained through public auction. Staff has estimated, based on research, that the value is between $10,000 and $14,000, which the City will forego by donating to these agencies.

A release of liability is included in each agreement.

POLICY ALTERNATIVE:

The surplus equipment can be sold at auction and/or send to a scrap metal recycler PUBLIC OUTREACH:

After analysis, it was determined that no public outreach is required for this issue.

ENVIRONMENTAL REVIEW:

The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determination that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines is not subject to CEQA. SUBJECT:

Consideration of a Revision to the Special Events Policy (No Budget Impact) (Parks and Recreation Director Leyman).

APPROVE
_________________________________________________________ RECOMMENDATION:

Staff recommends that the City Council consider and approve a revision to the City’s Special Events policy.

FISCAL IMPLICATIONS:

There are no fiscal implications associated with the recommended action.

BACKGROUND:

The City Council initially adopted the City of Manhattan Beach Policy for Special Events on March 15, 1989.

At the July 17, 2018, City Council meeting, a revised Special Event Policy was approved to “establish clear guidelines for processing event applications to ensure compliance with local laws, facilitate collaborations among organizers, local authorities, public safety teams and other stakeholders; manage use of public resources effectively and fairly; establish protocols for crowd control, emergency response, traffic-management and security; and promote fairness and consistency in decision making, ensuring all event organizers are treated equally under the policy.”
The updated policy established an Impact Level approval process based on event impacts, clarified responsibility for third-party costs, and provided that organizations are eligible to apply

for legacy status after ten years of successful execution of their event in Manhattan Beach.

The current policy requires the following levels of approval:

A. Impact Level I events are low impact events requiring little to no City Resources.

Impact Level I characteristics may include but are not limited to:
i. 300 or fewer expected participants
ii. Event date is not in the peak season
iii. Event does not have amplified sound
iv. Event does not begin or end in Manhattan Beach (pass-through) B. Impact Level II events are medium impact events.

Impact Level II characteristics may include but are not limited to:
i. 300-1000 expected participants/attendees
ii. Event occurs on the weekend
iii. Event occurs in a park or facility
iv. Reserved parking may be requested
v. Street closures may be requested
vi. Event requires amplified sound
C. Impact Level III events are high impact events
Impact Level III characteristics may include but are not limited to:
i. Over 1,000 expected participants/attendees
ii. Involves alcohol on public property
iii. Event occurs on a Holiday
iv. Event occurs on the Strand or Pier area
v. Street closures are required
vi. Event occurs in Peak Season

Impact Level I events may be approved based on the recommendation of the Special Events Committee, comprised of representatives from each City department. If denied, an appeal may be made to the Parks and Recreation Commission.

Impact Level II events are reviewed by the Special Events Committee and reviewed and approved by the Parks and Recreation Commission. If denied, the applicant may appeal the decision to the City Council.

Impact Level III events require City Council approval after review by the Special Events Committee and Parks and Recreation Commission.

DISCUSSION:

As currently structured, Parks and Recreation Commission decisions on Level II events may be appealed to the City Council by the applicant upon denial. However, there is no provision allowing the City Council to call a decision (approval or denial of a Level II event) for review if they so desired. Accordingly, staff recommends revising the policy to clarify that the City Council may call for review any Level II special event approved or denied by the Parks and Recreation Commission within 30 days of the Commission’s decision. In order to accommodate this step, special event applications for Impact Level II events will need to be submitted at least 120 days

prior to the event. The current requirement for Impact Level II events is 90 days. This revision is also reflected in the revised policy attached.

In order to keep the City Council informed of Special Event decisions made by the Parks and Recreation Commission, events reviewed by the Parks and Recreation Commission will be listed on the City Council agenda under INFORMATIONAL ITEMS - Recent Parks and Recreation Commission Decisions on Special Events.

Other minor revisions proposed serve to update out-of-date information throughout the document (i.e. date, City Manager name, and website address).

PUBLIC OUTREACH:

After analysis, staff determined that public outreach was not required for this issue.

ENVIRONMENTAL REVIEW:

The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that there is no possibility that the activity may have a significant effect on the environment; therefore, pursuant to Section 15061(b)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary.

LEGAL REVIEW:

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.

After formal acceptance of EBS's work and the filing of the Notice of Completion, retention totaling $8,874.50 will be released to the contractor after a 35-day lien period. The unexpended amount of $16,143 from the Grants and Other Outside Funds will be disencumbered for use on

other future CDBG projects.

BACKGROUND:

The City of Manhattan Beach has participated in the Los Angeles Urban County CDBG Program, implemented by the Los Angeles County Community Development Authority (LACDA), for the past 20 years. On April 15, 2014, the City Council approved the current Participating City Cooperation Agreement in the Los Angeles Urban County CDBG Program.

On June 6, 2023, the City Council authorized expenditure of the CDBG funds for construction of accessible curb ramps consistent with the approved Fiscal Year 2024 through 2028 CIP Plan.

The project improved existing access ramps to comply with the latest ADA standards along routes to schools.

On May 7, 2024, City Council awarded a construction agreement to EBS for the construction of the CDBG Cycle 3 ADA Curb Ramp Project (LACDA Project No. 602599-23). The contracted scope of work consisted of replacing nine pedestrian ramps at three separate intersections . On July 7, 2024, City Council approved Resolution Nunc Pro Tunc No. 24-0079 correcting clerical errors relating to the amount of the contract award and the contingency authorization.

DISCUSSION:

Construction began on October 15, 2024 and was completed November 12, 2024. The City processed one change order in the amount of $1,460 for additional pavement restoration work and quantity adjustments, bringing the total cost of construction to $177,490. $176,030.00 Original Agreement Amount
+$17,603.00 Authorized Contingency
$193,633.00 Total Construction Budget
-$177,490.00 Total Expenditures
$16,143.00 Returned to Grants and Other Outside Funds

The Contractor has completed all contract work and is now requesting formal acceptance of the project.

On January 28, 2025, LACDA performed a Labor Compliance File Review for the project. No deficiencies were noted during the review, and a Labor Compliance Clearance letter was subsequently issued on January 30, 2025.

The retention amount of $8,874.50 will be released 35 days after recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications and of good quality.

PUBLIC OUTREACH:

The work was coordinated and scheduled to minimize impacts to the area residents and businesses. Additionally, notifications were delivered to nearby properties in advance of the work.

ENVIRONMENTAL REVIEW:

The project was previously evaluated for compliance with the California Environmental Quality Act (CEQA), and a determination was made that the project qualified for a Categorical Exemption pursuant to Section 15301(c) of the State CEQA Guidelines (the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use; including existing highways, streets, or sidewalks). There are no features that distinguish this project from others in the exempt class; therefore, there are no unusual circumstances.

LEGAL REVIEW:

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.

BACKGROUND:

The Lot 3 Parking Structure was a City-owned facility at the southwest corner of Morningside Drive and 12th Street in Downtown Manhattan Beach. The three-story structure was constructed in 1971 and contained 146 parking spaces critical to visitors and businesses in the Downtown area. In June 2024, City staff elected to close the structure indefinitely, following a series of onsite inspections and structural assessments indicating that advanced deterioration had significantly compromised the integrity of the structure. At the September 3, 2024 regular City Council meeting, City Council adopted Resolution No. 24-0105, declaring a local emergency at Lot 3 and authorizing the City Manager to secure, demolish, and replace the structure.

In addition to adopting Resolution No. 24-0105, City Council directed staff to explore means to expedite the work, including, but not limited to, extending construction work hours. Furthermore, City Council directed staff to discontinue temporary shuttle services and to identify and/or create additional parking spaces within walking distance of the Downtown area. City Council also directed staff to suspend parking restrictions in the Downtown Resident Permit Parking Area.

Additional discussions included considering alternate locations for the Farmer’s Market, providing a shuttle service for special events, and evaluating the potential for valet parking.

Per Resolution No. 12-6422, which was adopted by City Council on December 4, 2012, in the event of an emergency, the City Manager is authorized to take action during an emergency pursuant to California Public Contract Code (California PCC) Section 22050. Section 22050 provides that the City Manager may order the repair of public facilities without advertising for bids when the repair is in the public interest and necessitates the immediate expenditure of public money to safeguard life, health, or property.

California PCC Section 22050 requires that if the City Manager orders an emergency action, the governing body shall initially review the emergency action at its next regularly scheduled meeting and at least at every regularly scheduled meeting thereafter until the action is terminated, to determine, by a four-fifths vote, that there is a need to continue the action. This staff report serves as the update required by Section 22050. Previous updates were provided at all City Council Regular Meetings held between September 17, 2024 and February 18, 2025.

DISCUSSION:

Emergency Demolition
Demolition activities concluded on November 22, 2024, and 12th Street was re-opened to traffic that same day. Center Place was re-opened for use as a delivery zone on November 27, 2024.

The Lot 3 site is now vacant and currently secured with chain-link perimeter fencing.

Interim Parking Lot
Construction documents for the interim parking lot were released for bid during the week of February 24, 2025. Contractors wishing to submit a bid can access the documents and submit their bid on the OpenGov procurement site. Bids are due on Wednesday, March 19, 2025 at 11:00 a.m., after which time the City will review bids and award a contract to the low bidder in accordance with the provisions of the California Public Contract Code and the City’s purchasing policies.

Public Works intends to award a construction contract before the end of March, with a projected completion by end of May 2025.

Refuse Enclosure Licensing Agreements
A refuse enclosure will be constructed within the interim lot to house the private recycling containers that were stored within the Lot 3 Parking Structure prior to demolition. During the February 18, 2025 Regular City Council Meeting, staff presented a set of proposed fees for the use of the refuse enclosure. Per the direction received, a $3 per square foot fee will be incorporated into all licensing agreements between the City and individual business owners who wish to store their containers within the interim lot.

Permanent Redevelopment Options for Parking Lot 3
On December 9, 2024, the City Council received a presentation from Kosmont Companies regarding potential scenarios and alternative options for the redevelopment of the Lot 3 site.

The Council considered several options.

During the meeting, staff was directed to perform more research regarding the options available to the City and to return to the City Council with additional information.

Project Impacts to Farmer’s Market
Per City Council direction, the Farmer’s Market that is held every Tuesday by the Downtown Business and Professional Association (DBPA) has been temporarily relocated from its typical location near 13th Street and Morningside Drive to the Civic Center Plaza and Civic Center Parking Lot. Staff secured an amendment to the City’s agreement with the DBPA to address this change. A timeline for returning the Farmer’s Market to the original location has not yet been established.

PUBLIC OUTREACH:

Formal public notice is not required for this item; however, the item was included in the agenda for this meeting, which was posted in accordance with the law. Additionally, staff has conducted significant outreach by speaking with businesses about parking impacts and coordinating communication and outreach with the DBPA and businesses that formerly used the refuse

enclosure in Lot 3.

ENVIRONMENTAL REVIEW:

The City previously reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and determined that the demolition of Lot 3 was covered by the statutory exemption for Emergency Projects (State CEQA Guidelines Section 15269) because the demolition was necessary to address a clear and imminent danger, and required immediate action to prevent or mitigate loss of, or damage to, life, health, property, or essential public services. Because the structure overhung the public right of way on three sides, collapse posed a threat to life, health, property and essential public services.

Additionally, the City previously determined that the interim surface parking aspect of the project qualifies for the following categorical exemptions:

- Class 1 categorical exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines because the project would modify the ground floor of a parking facility (that existed at the time the determination was made) to provide fewer parking spaces than the prior facility, thus resulting in no expansion of the prior use. - Class 2 categorical exemption pursuant to Section 15302 (Replacement or Reconstruction) of the State CEQA Guidelines because the parking structure would be replaced with a flat parking lot with substantially the same purpose as the now-demolished structure and substantially the same capacity as the ground floor of the now-demolished structure.

- Class 4 categorical exemption pursuant to Section 15304 (Minor Alterations to Land) of the State CEQA Guidelines because grading necessary to accommodate a surface parking lot would occur at a lot that has less than 10 percent slope, is not in a waterway, wetland, or scenic area, and is not in officially mapped areas of geological hazard.

The actions under consideration at this time remain part of the previously analyzed project and no further environmental review is necessary.

LEGAL REVIEW:

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.

Consideration of Approving Fee Waivers Associated with Legacy Special Events for Fiscal Years 2026-2030 (Partially Budgeted) (Parks and Recreation Director Leyman). (Estimated Time: 30 Mins.)

APPROVE
_________________________________________________________ RECOMMENDATION:

Staff recommends that the City Council approve the fee waivers associated with legacy special events for fiscal years 2026-2030.

FISCAL IMPLICATIONS:

Per prior City Council direction, staff applied fully-burdened rates in determining the true costs associated with each special event request. Fully burdened rates include City overhead as well as direct costs to the City. These are the rates adopted by City Council in the resolution of fees.

The funds to provide these services are budgeted annually within each of the affected City departments.

Any related equipment utilized is charged at the prevailing rental fee. Parking rates were calculated at $2.50 or $2.00 per hour depending on location.

The total requested fee waivers is $490,705, including approximately $75,869 in third-party costs contributing to the cost of events. Per the Special Events Policy, organizers are responsible for reimbursing the City for third-party costs unless granted an additional waiver by the City Council.

BACKGROUND:

Page 1 ends

City Council Meeting
March 4, 2025

File Number: 25-0068
Prior to 2003, City Council elected to exempt three events from paying City fees for special events. The Holiday Fireworks Festival, Manhattan Beach 10K Run, and the Little League Parade were considered special events of communitywide interest, too valuable to lose and too expensive for the City to implement by itself.

On April 7, 2009, the City Council approved 75% fee waivers for all “legacy” organizations (except the Holiday Fireworks Festival, Manhattan Beach 10K Run, and Little League Opening Day Parade who retained 100% waivers), and approved waiving all fees for legacy special events associated with the Manhattan Beach Unified School District, including the Manhattan Beach Wine Auction.

After six years of revisiting special event fee waivers for legacy events annually, the City Council felt that it was demonstrated that the fee waiver process was an effective way to acknowledge legacy organizations and their positive and beneficial impact on the community and residents.

On March 17, 2015, the City Council approved five-year fee waivers for legacy special events to be in effect for fiscal years 2016-2020.

The City Council granted the Hometown Fair a 100% fee waiver instead of a 75% fee waiver on September 17, 2017.

At the July 17, 2018, City Council meeting, a revised Special Events Policy was approved, establishing a tiered approval process and clarifying that the fee waiver covers only City services and fees, making all third party costs the responsibility of the event organizers.

At the June 9, 2020, City Council meeting, the following actions were taken:

1. Fee waivers were approved for fiscal years 2021-2025 with the condition that the City Council revisit the waiver for any event if estimated costs increased by 10% or more.

2. North End Holiday Stroll was approved as a legacy event and was granted a 100% fee waiver for City services.

3. A cap of $10,000 per year was established for third-party expenses for the Holiday Fireworks.

On February 21, 2023, City Council approved legacy status for the Catalina Classic and Tour de Pier, granting a 100% fee waiver for City services for the Tour de Pier.

The Hometown Fair was approved for a $10,000 cap on public safety related expenses with a built-in annual CPI increase, as part of the ten-year agreement approved by City Council on August 1, 2023. The cap for FY 2026 is $10,609.

On August 6, 2024, the City Council approved waiver of third-party safety costs for the 2024 Manhattan Beach 10K. Security costs for the 2024 event totaled $6,028.

DISCUSSION:

Legacy events have been reviewed by all City departments with each department estimating necessary services based on past history and projected needs.

There are eleven legacy events currently receiving fee waivers.

A summary of projected fee waivers along with a detailed breakdown of estimated costs by department are attached. City cost estimates include but are not limited to hardware and staffing costs; administration for event meetings and pre- and post-event inspection; use of City equipment, such as water barricades, sawhorses, and message boards; GIS mapping and cost of developing a traffic control plan.

Special events costs, especially those associated with public safety, continue to grow as event attendance expands. The level of security personnel is determined by the Police Department. In some cases, security costs may be reduced or eliminated by utilizing volunteers, but many of the event organizers have expressed difficulty in securing volunteers for this purpose.

As outlined in the Special Events Policy, third-party costs are the responsibility of event organizers. Final billing is based upon actual resources used during the event.

Staff is seeking direction on:

1. Continuing to offer the caps for public safety expenses to the MB10K and Holiday Fireworks and,

2. If the City Council would like to retain the 10% trigger for additional fee waiver review by City Council for fiscal years 2026-2030, or provide alternate direction to return for review if the event operator requests additional City Services in order to change or expand an event.

CONCLUSION:

Staff recommends that the City Council approve the fee waivers associated with legacy special events for fiscal years 2026-2030.

ENVIRONMENTAL REVIEW:

The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that there is no possibility that the activity may have a significant effect on the environment; therefore, pursuant to Section 15061(b)(3) of the State

Review and Discussion of the Boards and Commissions Interview Process (No Budget Impact) (City Clerk Tamura).
(Estimated Time: 15 Mins.)

DISCUSS AND PROVIDE DIRECTION
_________________________________________________________ RECOMMENDATION:

It is recommended that the City Council discuss the process options provided herein for the Boards and Commissions interview process and provide direction to staff.

FISCAL IMPLICATIONS:

There are no fiscal implications associated with the recommended action.

BACKGROUND:

At the February 4, 2025, City Council meeting, City Council directed staff to assess and consider modifications to the boards and commissions interview process to improve the effectiveness, efficiency, and overall interview experience for applicants and City Councilmembers.

The City of Manhattan Beach's Boards and Commissions play a critical role in advising the City Council on key policy matters. Annually, the City Clerk presents the list of vacancies to the City Council, followed by advertisements in the Beach Reporter in January, February, March, and April. These advertisements indicate the number of open seats available. Additional outreach includes posting notices on the City bulletin boards and website, along with recruitment

advertisements through the City’s GovDelivery notifications and social media channels.

The general application format is consistent for most boards and commissions, though student representatives use an alternative application format. The established application deadline serves as a procedural step to allow time for the City Clerk’s office to compile and distribute applications, verify applicants' qualifications, and meet agenda publishing deadlines.

Currently, interviews are conducted virtually, with candidates given two minutes to provide a brief background and explain why they are a strong candidate before appointments are made at the following City Council meeting. This process has been in place since the COVID-19 pandemic in 2020.

DISCUSSION:

City Council has directed staff to explore alternative procedures for the interview process for the Boards and Commissions. Historically, interviews have been conducted in three different formats. These options are outlined below:

Speed-Style Interviews:

City Council can choose to conduct Speed-Style interviews held at the Police/Fire Conference Room, or an alternate City location if needed. Interviews will be scheduled in 15-minute intervals with groups of five candidates. Each City Councilmember will interview each candidate for two minutes. After all candidates have met with each City Councilmember, the first group will exit, and the next group will begin. Following the interviews, appointments will be made at a Regular City Council meeting.

Interviews at a City Council Meeting:

City Council can request a separate meeting for interviews. Applicants will take turns approaching the podium. Each candidate will be given ten minutes to provide a brief background and explain why they are a strong candidate. Each City Councilmember will have the opportunity to ask a question of their choice or pose the same question to each candidate from a list approved by the Staff Liaison. Following the interviews, appointments will be made at a Regular City Council meeting.

Virtual Interviews:

During the COVID-19 pandemic in 2020, the City Council transitioned to conducting interviews virtually. Each candidate is given two minutes to provide a brief background and explain why they are a strong candidate. Due to the large number of applicants, engagement or follow-up questions are generally not provided. Following the interviews, appointments will be made at a Regular City Council meeting.

In preparation for the City Council’s discussion, staff reached out to the League of California Cities ListServe group for City Clerks to gather insight on how other cities conduct their annual boards and commissions interviews. Eleven municipalities responded, and their feedback has been compiled into a list (see attachment).

CONCLUSION:

Staff recommends that the City Council discuss the proposed changes to the Boards and

Commissions interview process and provide direction to staff. By improving the applicant’s experience and streamlining the appointment procedure, these adjustments will further ensure the City attracts and selects qualified individuals for its Boards and Commissions.

Consideration of a Resolution Approving an Agreement for Prosecutorial Services on an As-Needed Basis (No Budget Impact) (City Manager Mirzakhanian and City Attorney Barrow). (Estimated Time: 15 Mins.)
ADOPT RESOLUTION NO. 25-0023
_________________________________________________________ RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 25-0023 authorizing the City Manager to approve an agreement for prosecutorial services with the Law Firm of Dapeer Rosenblit & Litvak LLP.

FISCAL IMPLICATIONS:

The proposal for prosecutorial services from Dapeer Rosenblit & Litvak LLP (“DRL”) is on an as-needed basis. As such, the fiscal implications are unknown at this time until staff is able to monitor expenditures depending on the legal services provided. However, Richards Watson Gershon (“RWG”) currently provides the proposed services at aligned rates, so the full cost of services would be offset by a reduction in legal fees paid to RWG, and within budgeted amounts. Staff will closely monitor the billing and legal services provided. As noted below, staff will present to the City Council quarterly updates that will include the metrics of the services, including legal fees and costs incurred.

BACKGROUND:

In 2023, the City Council explored different ways to reinforce prosecution of both local laws and State laws. In light of the then-current Los Angeles District Attorney, the City sponsored Assembly Bill 2309 to allow city attorneys for general law cities to prosecute State misdemeanors. AB 2309 did not pass the State Legislature. In November 2024, the Los

Angeles County voters elected a new District Attorney.

DISCUSSION:

From time to time, the City has delegated criminal prosecution, and other legal services, to special counsel. Historically, the City relied on such counsel to handle all Municipal Code violations. After the Council amended the Municipal Code in 2016 to add Chapter 1.06 (Administrative Citations), Municipal Code violations and others violations historically handled through criminal prosecution have been primarily handled via an administrative citation process.

1.06.020 - Code enforcement authority provides:
“A. This Chapter provides for an administrative remedy for any violation of the Code. This remedy may be exercised in place of, or in addition to, any administrative, criminal, civil, or equitable remedy allowed by law. The City Attorney or City Prosecutor shall have sole discretion to determine whether a violation will be prosecuted criminally.” Most violators will pay the administrative fine, and discontinue the behavior, without any attorney involvement or City incurring legal fees. Accordingly, the most cost effective and efficient way to obtain code compliance and deter repeat offenses is through the administrative citation process. If needed, DRL can assist staff with administrative citations.

However, there may be situations where violations should be treated as a misdemeanor or infraction. In some cases, citing offenders with an administrative citation may not obtain code compliance or deter repeat offenses. Pursuant to the Manhattan Beach Municipal Code, every Code violation is a misdemeanor, unless specified otherwise, but can be treated as an infraction:
“1.04.010 - Violations a misdemeanor.

It shall be unlawful for any person to violate any provision, or to fail to comply with any of the requirements of this Code or any condition of any permit or license approved pursuant to any provision of this code. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this Code shall be guilty of a misdemeanor, unless it is specifically stated in the applicable chapter that it is an infraction, or unless such violation is subsequently prosecuted as an infraction, in which case such person is guilty of an infraction.”

DRL was identified as one of the preeminent firms specializing in providing prosecution legal services to cities. As shown in the attachment, DRL currently represents numerous cities, including Beverly Hills, Covina, West Hollywood, Culver City, Diamond Bar, Calabasas, and Agoura Hills. DRL has worked closely with several in-house city attorneys and contract city attorneys, including RWG partners. As shown in the attachment, DRL has exhibited client retention, representing several cities since the 1980s, and at least one of its city clients since 1979. DRL’s proposal proposes to prosecute criminal violations (e.g., Municipal Code misdemeanors and infractions) and perform such services as are requested by the City Attorney, City Manager, or their designees. In addition, DRL may also provide services related to civil investigations, obtaining warrants, and filing civil actions, upon request.

Upon execution of an agreement, on a quarterly basis, or more frequently as requested, DRL will

provide a status report on cases handled by the firm, and the City may request changes to the legal services performed, including reduction in the number of cases forwarded to DRL.

CONCLUSION:

With the change in administration in Los Angeles County, the District Attorney’s Office may resume prosecuting State misdemeanors on behalf of the City. However, the City needs a private firm to prosecute Municipal Code violations. Staff recommends that the City Council adopt draft Resolution No. 25-0023 authorizing the City Manager to execute an agreement in accordance with City Council direction.
