Under the Brown Act, the Council is limited to discussing the “price and terms of payment” regarding the acquisition of real property in closed session. The price of this property and the method of payment is set out in detail in the open session Item #10 staff report. I’m hard-pressed to understand what is left for the Council to discuss in closed session about this acquisition. Closed sessions pertaining to real estate are limited to giving direction to the City’s negotiator in connection with ongoing negotiations. I would ask that the Council or the City Attorney explain specifically why this closed session is appropriate under the Act when it seems that the terms of the acquisition have already been fully negotiated.
