ORDINANCE NO. 25-0005
AN ORDINANCE OF THE CITY OF MANHATTAN BEACH
AMENDING THE MANHATTAN BEACH MUNICIPAL CODE
TO INCREASE THE MEMBERSHIP OF THE LIBRARY
COMMISSION AND THE CULTURAL ARTS COMMISSION
THE MANHATTAN BEACH CITY COUNCIL HEREBY ORDAINS AS FOLLOWS:
SECTION 1. The City Council hereby amends Manhattan Beach Municipal Code Section 2.44.030 relating to the m embership of certain City Commissions to read as follows:
2.44.030 - Membership.
Members of Boards, Commissions, and Committees shall be appointed by the City Council. The Parks and Recreation Commission shall consist of seven members.
The Cultural Arts Commission and Library Commission shall each consist of seven members. The Planning Commission, the Parking and Public Improvements Commission and Board of Building shall consist of five members each.
Membership criteria for individual Boards, Commissions, and Committees shall be separately authorized by the City Council.
SECTION 2. Severability. If any section, subsection, sentence, clause, or phrase of this ordinance, or any part thereof, is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause, or phrase would be subsequently declared invalid or unconstitutional.
SECTION 3. Compliance with California Environmental Quality Act . The City Council finds that Ordinance No. 25-0005 is not subject to the California Environmental Quality Act pursuant to Section 15060(c)(2), constituting an activity that will not result in a direct or reasonably foreseeable indirect physical change in the environment, and pursuant to Section 15060(c)(3), constituting an activity that is not a project as defined in Section 15378.
SECTION 4. Certification and Publication . The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published or posted in the manner prescribed by law.
