A RESOLUTION OF THE MANHATTAN BEACH CITY
COUNCIL AUTHORIZING THE CITY MANAGER TO
APPROVE AMENDMENT NO. 3 TO THE SOLID WASTE
FRANCHISE AGREEMENT BETWEEN THE CITY OF
MANHATTAN BEACH AND WASTE MANAGEMENT TO
REDUCE SOLID WASTE DIVERSION REQUIREMENTS
THE MANHATTAN BEACH CITY COUNCIL HEREBY RESOLVES AS
FOLLOWS:
SECTION 1. Pursuant to that certain Franchise Agreement for Integrated Solid Waste Management Services between the City of Manhattan Beach and Waste Management (WM) dated December 10, 2019 (“Agreement”), WM is required to divert at least 50% of the waste it collects from landfills. Due to difficulty in complying with that requirement, WM has requested to reduce solid waste diversion requirements in the City’s Franchise Agreement. If the City Council grants the request, the contractor rate for both FY 2025 -2026 and FY2026 -2027, as well as the corresponding r esidential and commercial billing rates, would be reduced by 1%.
SECTION 2. The City Council hereby delegates to the City Manager to the authority to approve and execute Amendment No. 3 to the Franchise Agreement between the City of Manhattan Beach and WM, consistent with City Council direction.
SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution.
