RESERVOIR BOOSTER STATION
4 5 THE CITY COUNCIL OF THE CITY OF MANHATTAN BEACH DOES HEREBY RESOLVE:
7 Station recently tailed after an incoming voltage spike from the electrical power utility, which 8 damaged the motors beyond repair. In order to maintain appropriate pressure in the City's water system, staff determined that the pump motors needed to be replaced immediately. 9 Section 2. On August 13, 2012, the City staff placed an emergency call to 10 General Pump Company, Inc. ("Contractor") for them to replace and install two submersibl booster pump motors at the Peck Reservoir Booster Station. On October 18, 2012, the Contractor completed the installation of the two pump motors. 11 Based upon the foregoing, and based upon substantial evidence in 12 the record, including but not limited to the staff report and public comment, and in accordance with California Public Contract Code Sections 20168 and 22050, the City Council hereby:
13 A. Declares that the public interest and necessity demanded the immediate expenditure of public money to safeguard life, health or property;
14 B. Finds that the above described emergency would not allow for the delay that would result from a competitive solicitation of bids; and
15 C. Authorizes City staff to take any directly related and immediate action required by the emergencies, and procure the necessary equipment, services, and supplies for those 16 purposes, without giving notice for bids to let contracts for such repair. 17 Section 4. In accordance with Public Contract Code Section 22050(b)(1), the City Council hereby delegates to the City Manager the authority to order any action specified 18 in Public Contract Code Section 22050(a)(1) and to expend funds without complying with state competitive bidding requirements, both in relation to the above-mentioned emergency 19 and in relation to any future emergency.
20 Section 5. This Resolution shall take effect immediately. The City Clerk shall make this Resolution available for public inspection.
21 Section 6. The City Clerk shall certify to the adoption of this Resolution and thenceforth and thereafter the same shall be in full force and effect. 22 23 PASSED, APPROVED AND ADOPTED this 4th day of December 2012.
