Sections:

14.42.010 - Paid parking zones.

A. The City Council shall by resolution establish paid parking zones on City owned or controlled on and off-street parking facilities.

B. The regulation of vehicle parking by paid parking devices and the requirement for paid parking in paid parking zones shall become effective upon the installation of paid parking devices, as designated by the City Manager.

C. In the event no paid parking device is installed for a parking space within a designated paid parking zone, the maximum time for parking in any such space shall be that which is permitted or provided for under the provisions of this Code, related resolution, or any other law or regulation of the City.

14.42.020 - Paid parking rates; days and hours of paid parking enforcement; time limits.

The City Council shall by resolution establish the range of paid parking rates, days and hours of paid parking enforcement, and time limits for paid parking zones.

14.42.030 - Payment required.

No person shall park a vehicle within a paid parking zone during such time that payment is required without immediately depositing payment with a paid parking device, except during such time as is reasonably necessary to initiate a parking session for such vehicle or as otherwise permitted by this title, unless the paid parking device indicates at the time such vehicle is parked that an unexpired portion remains of the period of time for which a payment has previously been deposited.

14.42.040 - Paid parking violations.

It shall be unlawful and a violation of the provisions of this chapter for any person to do the following:

A. Attach or allow to lean against a paid parking device any bicycle, news rack, fabric, handbill, flier, sticker, note, or other object.

A separate violation of this provision shall occur each and every period during which such violation exists.

E. Re-park a vehicle within the same paid parking zone in order to extend the vehicle's parking time beyond the maximum parking limit limits established for the specific paid parking zone. For purposes of this section, a vehicle shall be deemed "re-parked" and in violation hereof if a vehicle is parked in any public parking space within the same paid parking zone during a set “time-out” period as established by resolution of the City Council, which begins after the maximum posted time limit as measured from the time the vehicle is first parked within the paid parking zone. Furthermore, the City Council hereby finds that there is no possibility that the Ordinance may have a significant effect on the environment pursuant to CEQA Guidelines Section 15061(b)(3) because imposing regulations on public parking authorized by this Ordinance will not result in a permanent alteration of property nor the construction of any new or expanded structures or other direct or indirect physical changes in the environment. The Ordinance is an administrative process and regulates the manner in which vehicles are parked on public property.

SECTION 6. Any provisions of the Municipal Code, or appendices thereto, or any other ordinances of the City, to the extent that they are inconsistent with this Ordinance, are hereby repealed.

SECTION 7. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause, and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional.

SECTION 8. This Ordinance shall take effect and be in full force and operation 30 days after its final passage and adoption.

SECTION 9. The City Clerk shall certify to the passage and adoption of this Ordinance and cause a summary of this Ordinance to be published as provided by law. The summary shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted.
