RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, 1) APPROVING THE ENGINEER’S REPORT FOR THE SOUTHWEST MANTECA REGIONAL SEWER LIFT STATION IMPROVEMENTS AREA OF BENEFIT AND FORMING THE SOUTHWEST MANTECA REGIONAL SEWER LIFT STATION IMPROVEMENTS AREA OF BENEFIT DISTRICT, 2) APPROVING THE IMPROVEMENT AGREEMENT FOR THE SOUTHWEST MANTECA REGIONAL SEWER LIFT STATION, AND 3) ACCEPTING A GRANT DEED AT 2368 W. WOODWARD AVENUE FROM THE PROPERTY OWNER FOR A 10,520 SQUARE FOOT PROPERTY FOR INSTALLATION OF THE SOUTHWEST MANTECA REGIONAL SEWER LIFT STATION AND A 70,797 SQUARE FOOT PROPERTY FOR THE JOSHUA STREET RIGHT-OF-WAY WHEREAS, in accordance with the City of Manteca’s (the City) Wastewater Conveyance System Master Plan, the sanitary sewer outfall for the southwest area of the City is a regional lift station located on the west side of the future Joshua Street on the Trails of Manteca subdivision property; and WHEREAS, Meritage Homes, the developer of the Cerri subdivision, will be constructing a sewer lift station to facilitate their project; and WHEREAS, the City required Meritage Homes to construct the Southwest Manteca Regional Sewer Lift Station (SMRSLS) and size it to accommodate future development in the area; and WHEREAS, the landowner of The Trails subdivision has worked with the landowner to dedicate the property for the lift station and the right-of-way for Joshua Street at this time to allow for construction to begin on the SMRSLS; and WHEREAS, in accordance with City of Manteca Municipal Code and Resolution No. R1996-132, Area of Benefit Establishment Criteria, both developers are entitled to reimbursement for costs incurred to facilitate construction of the SMRSLS from the properties which will benefit from the SMRSLS; and WHEREAS, in accordance with R1996-132, the engineer for Meritage Homes has submitted an Engineer’s Report for the Area of Benefit formation which has been reviewed and approved by the City and circulated to the beneficiaries for review and comment; and WHEREAS, prior to construction of infrastructure that will be dedicated to the City, the developer must enter into an Improvement Agreement with the City and submit bonds, in accordance with Title 16 of the City’s Municipal Code; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves the Engineer’s Report for the Southwest Manteca Regional Sewer Lift Station Area of Benefit and forms the Southwest Manteca Regional Sewer Lift Station Area of Benefit District.
The City Council hereby approves the Improvement Agreement for the Southwest Manteca Sewer Lift Station.
The City Council hereby accepts the Grant Deed at 2368 W. Woodward Avenue from the property owner for a 10,520 square foot property for installation of the Southwest Manteca Regional Sewer Lift Station and a 70,797 square foot property for the Joshua Street right-of-way.
3. The City Clerk is hereby instructed to record this Resolution and the Engineer’s Report on the title of each beneficiary property with the San Joaquin County Recorder’s Office.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 18th day of January, 2022, by the following vote:
