NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. The project is exempt from the California Environmental Quality Act (CEQA) review, per CEQA Guidelines Section 15332, Class 32, Infill Development. This exemption applies to projects characterized as in-fill development in which the project is consistent with the applicable general plan designation and all applicable general plan policies, as well as with the applicable zoning designation and regulations. The project is located on a site less than five acres (.89 acres). It is designated as an ‘Urban’ habitat zone, and is not expected to have value as a habitat for endangered, rare, or threatened species, but will still comply with requirements from the SJCOG Habitat Conservation and is subject to a habitat survey prior to building permit issuance. This project will also comply with all requirements from the San Joaquin Valley Air Pollution Control District prior to building permit issuance, and this site can be adequately served by all utilities and public services. Therefore, no further Environmental Review is required.
3. The City Council hereby adopts, as its own, the findings required to approve the Tentative Subdivision Map under Municipal Code Section 16.09.040, which are detailed in the Planning Commission Staff Report dated November 18, 2021, and hereby incorporated by reference into this Resolution.
4. Based on the foregoing, the City Council hereby approves the Tentative Subdivision Map attached hereto as Exhibit “A”, subject to all conditions attached hereto as Exhibit “B”.
