RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, OVERTURNING THE DENIAL OF THE PLANNING COMMISSION AND APPROVING A SITE PLAN AND DESIGN REVIEW APPLICATION (FILE NO. SPC-21-74) FOR AN OFFICE AND ATTACHED STORAGE AREA AT 617 EAST YOSEMITE AVENUE WHEREAS, on November 18, 2021, the Planning Commission considered evidence and testimony on Raymus, LLC’s Site Plan and Design Review Application for a 238 square foot office building and incidental storage use on a .16-acre site located at 617 East Yosemite Avenue on Assessor’s Parcel Number 223-230-23 and, after contemplating the evidence and public testimony, voted 5-1 to deny the proposed project; and WHEREAS, on November 22, 2021, City of Manteca staff received a formal request from the applicant, Raymus, LLC, to appeal the Planning Commission’s denial of its Site Plan and Design Review Application to the City Council; and WHEREAS, on January 18, 2022, the City Council considered the appeal of Raymus, LLC and the evidence and public testimony on the project at a de novo hearing and, after contemplating the evidence and public testimony, the City Council voted to grant Raymus, LLC’s appeal, overturn the denial of the application, and approve the Site Plan and Design Review Application for a 238 square foot office building and incidental storage use on a .16-acre site located at 617 East Yosemite Avenue on Assessor’s Parcel Number 223-230-23; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The appeal of Applicant, Raymus, LLC, is hereby granted and the Planning Commission’s November 18, 2021 denial of its application for approval of SPC-21-74 is overturned.
The Findings for adoption of SPC-21-74, as contained in the Planning Commission Staff Reportare approved.
The proposed Site Plan and Design Review application is hereby approved subject to compliance with all conditions attached hereto as Exhibit “A” – Revised Project Plan Set and Exhibit “B” – Conditions of Approval.
The time within which judicial review must be sought for administrative decision is governed by California Code of Civil Procedure Section 1094.6 The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the Office of the City Clerk.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 18th day of January, 2022, by the following vote:
