Section 1 Introduction

1.1 AREA DESCRIPTION
The Southwest Manteca Regional Sewer Area of Benefit, hereto referred to as the “SMRSAOB”, is located south of Highway 120 on the west end of Manteca. The area encompasses properties both North and South of Woodward Avenue. The area requires a regional pumping system and associated infrastructure to discharge sewage into the existing City of Manteca Sewer Infrastructure. See Section 3 for a complete description of improvements included. Beneficiaries shall pay SMRSAOB Assessment for improvements constructed when parcels connect to the proposed system. The benefitting parcels areas are broken down into tributary areas as follows and are shown in Appendix A; “Regional Sewer Area of Benefit Tributary Map”:

1.2 METHODOLOGY
The Regional Sewer Improvements included with the SMRSAOB are designed to accommodate sewer discharge from all the parcels that are tributary to the Regional Sewer Lift Station. The sizing of the Regional Sewer Lift Station and associated infrastructure are designed under the peak sewer flow design criteria. Furthermore, all parcels listed in Table 1.1 are to be allocated based on the Peak Sewer Discharge (refer to Appendix A; “Regional Sewer Area of Benefit Tributary Map”). The peak sewer discharge is calculated based on Chapter 3, “Design Criteria” of the City of Manteca 2012 Wastewater Collection System Master Plan Update.

Section 2 Improvement Costs

2.1 IMPROVEMENT COSTS
Improvements contained in this agreement are essential to construct the proposed SMRSAOB improvements. The proposed improvements are limited to Regional Sewer Lift Station and associated infrastructure (see Section 3 for a more complete description of the proposed improvements). This report does not preclude the creation of future Areas of Benefit for properties north of Woodward Avenue for specific improvements that benefit those parcels referenced in this report.

Proposed Improvements are to be constructed by the Cerri Development (Meritage Homes – Area H).

These improvements are defined in Section 3 of this report. These improvements include the Regional Sewer Lifts Station, Sewer Force Main Discharge, and Sewer Improvements Crossing Woodward Avenue.

As approved by the City Engineer, If a portion of the improvements noted in Section 3, and the Engineer’s Estimate in Appendix B, are constructed by other Areas referenced in this report, that party (Area) shall receive a credit toward the amount owed by that development.

Refer to Appendix B for the “Southwest Manteca Regional Sewer Area of Benefit Exhibit”, and for the proposed Area of Benefit Fair Share Analysis (Cost Estimate). Improvement costs are based on contract cost, recent bids, and associated Mark-Ups noted in Section 2.2. Final Consultant Fees, Construction Costs, and Change Orders will be supplied directly from the Contractor to the City of Manteca Engineering department for review and approval. If the total costs differ from the estimates provided, then a “trueup” will be performed by the City Staff to update the AOB Distribution Table in Appendix D.

2.2 IMPROVEMENT MARK-UPS
The following markups will be used on all items other than land cost if required; the land cost is excluded from any markups.

Table 2.1 - Improvement Mark-Ups

DESCRIPTION DESCRIPTION
Design Engineering Actual Costs
Construction Staking 4.00%
City Engineering Plan Check Fee 1.02%
City Construction Inspection Fee 1.81%
City Bonding 1.00%
Developer Construction Management and Administration 5.00% Soils Engineering for Pad and Grading Balance 1.00%
City Administration 5.00%

2.3 COST ADJUSTMENT FOR INFLATION
The assessments provided herein shall be adjusted on January 1st of each year, based upon the change in the 20-City U.S. Average Engineering News Record Construction Index (ENR-Index). The adjusted cost shall be calculated by the City of Manteca Engineering Department using the formula:
• New adjusted assessment is equal to the initial assessment multiplied by ENR-Index for January 1st of the year the assessment is paid, divided by the ENR-Index for January, 2022. The adjusted cost shall be rounded to the nearest dollar ($1.00).

The ENR adjustment will end after 15 years; the assessment calculated in January 2037 will be the assessment in perpetuity.

Section 3 Improvement Segments

3.1 SEGMENT OVERVIEW
The Southwest Manteca Regional Sewer Area of Benefit has been broken down into two areas of improvement. The Primary Improvements are beneficial to all Development Areas within the Area of Benefit, whereas the Crossing of Woodward Avenue Improvements are only beneficial to Development Areas north of Woodward Avenue.

3.2 SEGMENT BREAKDOWN
Each area is responsible for their portion of the improvements based their percentage of sewer flow going into each Segment. The following Table 3.1 provides a breakdown of the Fair Share Percentage Analysis used to establish the initial cost due to each Area. See Appendix B for the detailed Engineer’s Estimate of proposed improvements costs, mark-ups, and credits.

Residential Land Uses
(Area D, E, G, and H)
• Payments will be made prior to issuance of a government permit which results in a connection leading to the Southwest Manteca Regional Sewer Lift Station specified in this Area of Benefit.
• A single lump sum payment shall be made for all lots within each final map.

The lump sum payment shall be calculated by multiplying $2,500 by the total number of lots within the final map. The payments shall continue to be made until the total assessment for each Area, as detailed in Appendix D, is paid in full.

Non-Residential Land Uses
(Area A, B, C, and F)
• Payments will be made prior to issuance of a government permit which results in a connection leading to the Southwest Manteca Regional Sewer Lift Station specified in this Area of Benefit.

Table 4.1 in Section 4.1 is a list of how much is to be collected from each Area. Appendix D provides a breakdown of costs per parcel. In all cases, these amounts are in January, 2022 dollars and must be adjusted in accordance with Section 2 (Cost Adjustment). As funds are collected, the proportionate shares of the amount collected will be disbursed to the City of Manteca (City Administration 5%) and the remainder will be distributed to the developer responsible for construction of the respective improvements.
