RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AUTHORIZING AND APPROVING AMENDMENTS TO THE MUNICIPAL CODE TO REFLECT CURRENT STAFF ASSIGNMENTS WHEREAS, the City of Manteca, by and through the City Council, approved an updated ordinance (Section 2.24.010) concerning the members of the Planning Commission in 2009; and WHEREAS, the ordinance states that the City Attorney and City Engineer, as ex-officio members, shall attend Planning Commission meetings; and WHEREAS, in July 2020, a new City Engineering Department was established, whereby the City Engineer relocated from the Development Services Department to his/her own, separate department (Engineering Department); and WHEREAS, the Development Services Department presently runs and manages the Planning Commission and its meetings; and WHEREAS, the proposed amendment as submitted to the City Council is to update the Municipal Code to be in line with current staffing assignments and Planning Commission practices; and WHEREAS, the City Council finds that the proposed amendments reflect the current practices of the Planning Commission and the staff assignments at the City; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves and authorizes the proposed amendments to the Municipal Code Section 2.24.010. The new language shall read:
2.24.010 Created—Number of members.
There is created a planning commission of the city. The planning commission shall consist of five members and one alternate member. The alternate member shall attend all meetings of the commission and is authorized to serve and vote in place of any regular member of the commission who is absent. The planning commission shall also consist of two ex officio members: the city attorney or his/her designee and the Director of Development Services or his/her designee. In addition, at the request of the Director of Development Services (made at least one day before a meeting), the City Engineer or his/her designee shall also attend the regular or special meeting of the planning commission. (Ord. 1437 § 1, 2009; prior code § 2-26) This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of February, 2022, by the following vote:
