AGENDA REVIEW AND SUPPLEMENTAL REPORTS:
Acting City Clerk Olivia Nashed announced COVID-19 guidelines for the meeting.
A. PUBLIC COMMENT: None.
B. CLOSED SESSION:
Mayor adjourned to closed session at 6:02 p.m.
B.1. 22‑066 CONFERENCE WITH LEGAL COUNSEL ‑ ANTICIPATED LITIGATION‑ 54956.9(d)(4) ‑ One (1) case. City of Manteca v. The Dow Chemical Company, et al., Case No. STK‑CV‑UPI‑2020‑0007160 (San Joaquin County Superior Court).
B.2. 22‑090 Significant exposure to litigation pursuant to Gov. Code § 54956.9(d)(2) ‑ One matter. Significant exposure to litigation in the opinion of the City Council on the advice of legal counsel, based on facts and circumstances that might result in litigation against the City, but which the City believes are not yet known to a potential plaintiff or plaintiffs, which facts and circumstances need not be disclosed (§ 54956.9(e)(1)).
B.3. 22‑093 PUBLIC EMPLOYEE APPOINTMENT: City Manager.
C. REPORT ON ACTION TAKEN IN CLOSED SESSION: Upon returning to open session at 6:50 p.m., City Attorney L. David Nefouse noted the following, for Item B.1, the City Council of the City of Manteca voted to accept settlement agreement with the Dow Chemical Company for the following terms: $6M for claims for Well 29; full release of liability for Well 29, with payment due by March 31; provision that if further contamination for additional wells, we can assert claims for those wells, and noted no reportable action for Item B.2 and B.3.
D. ADJOURNMENT: Mayor Cantu adjourned meeting at 6:53 p.m.
