Nature of Executive Management and Department Head Recruitment.

Except as may otherwise be provided elsewhere in the Manteca Municipal Code, City personnel rules, and/or as set by the City Council, the nature and type of recruitment and assessments to be conducted for each department head position shall be determined by the City Manager in conjunction with the Human Resources Department. The assessment techniques used shall be impartial, shall use job-related screening requirements, and shall fairly determine the qualifications and the relative merit and fitness of candidates for the classification and position to be filled.

In his/her sole discretion, the City Manager shall determine whether the recruitment for a department head position shall be limited to internal candidates only; provided, however, should an internal recruitment for a department head not yield a minimum of two (2) internal candidates who clearly meet the minimum qualifications for the department head position, then the City Manager must open the recruitment to an external recruitment process that shall run a minimum of three (3) weeks.

The City Manager may also, in his/her sole discretion (but subject to and consistent with City personnel rules) utilize an approved list to fill a department head position following an external search only; however, the list shall only be valid for this purpose for up to one (1) year, and the list shall be limited to the top three (3) candidates (thus the candidates who were the runner-up, third place, and fourth place candidates, respectively).

Candidates with comparable qualifications shall be treated in a similar manner in the hiring process. Comparable qualifications include a candidate's education, training, experience, competencies, knowledge, skill, abilities, aptitudes, accomplishments and interests. Qualified candidates shall be considered for appointment to the position. All candidates for a position must also meet minimum qualifications for the class.

The following positions shall be the only positions subject to this policy: Police Chief; Fire Chief; City Clerk; Assistant City Manager; Director of Development Services; Director of Engineering (City Engineer); Director of Information Technology; Director of Finance; Director of Human Resources; and the Public Works Director.

Nothing in this policy shall preclude the City Manager from appointing an Interim or Acting department head, subject to all other City personnel rules and applicable Manteca Municipal Code provisions.

City Manager and City Attorney Recruitment
Per Chapters 2.08 and 2.09 of the Manteca Municipal Code, respectively, the City Council is the sole authority who appoints and approves the positions of City Manager and City Attorney.

In contrast to other executive management and department head positions, the City Council now mandates that in order to permanently fill these positions, the City shall conduct an external recruitment, subject to the terms and conditions set out by the City Council.

If there is a vacancy in either position within six (6) months following the start date of the City Manager or City Attorney, the City Council may (in its sole discretion) offer the position to the candidate who was the runner-up in the selection process.

Nothing in this policy shall preclude the City Council from appointing an Interim and/or Acting City Manager or City Attorney, respectively, subject to all other City personnel rules and applicable Manteca Municipal Code provisions.
