RESOLUTION R2022-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, TO accept the grant deeds (APN 228-060-25 partial and 224-050-19 partial) that Caltrans acquired for the State Route 99 and 120 Improvement Project, authorizE the City Manager or designee to execute the Certificate of Acceptance (COA), and direct the City Clerk to cause the associated deeds to be recorded in the office of the San Joaquin County Recorder WHEREAS, for the Caltrans State Route (SR) 99 and 120 Improvement Project, it is necessary to obtain the full Right-Of-Way (ROW) required to build and/or widen the roadways; and WHEREAS, the ROW acquisitions also establish the required setbacks and easements for the proposed project; and WHEREAS, the subject Grant Deeds (APN 228-060-25 partial and 224-050-19 partial) accomplish the purposes required for said project; and WHEREAS, as part of the project, the City Council needs to adopt a resolution to accept the grant deeds, authorize execution of the Certificate of Acceptance, and confer authority to the City Manager or designee to accept, execute, and consent to the recording of documents transferring real properties; and WHEREAS, upon City Council approval of the subject Grant Deeds, the City Manager or designee is authorized to sign on behalf of the City and give direction for recording all associated documents; and WHEREAS, since Caltrans will implement the process for administering ROW acquisitions, there will be no cost associated with the Acceptance of Certificate to the City of Manteca and there is no General Fund impact; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council adopts a resolution accepting the grant deeds from Caltrans for the portions of the SR99/120 Improvement Project (APN 228-060-25 partial and 224-050-19 partial), authorizing the City Manager or designee to execute the Certificate of Acceptance, and directing the City Clerk to cause the associated deeds to be recorded in the office of the San Joaquin County Recorder This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 5th day of April, 2022, by the following vote:
