RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ADOPTING A MITIGATED NEGATIVE DECLARATION AND APPROVING a tentative subdivision map for THE 320 AIRPORT WAY subdivision at 320 NORTH AIRPOrT WAY FILE NO. SDJ 21-42
WHEREAS, the Manteca City Council, at its duly noticed public hearing on ______________, 2022, considered a Tentative Subdivision Map filed by Michael Kiper with 320 Airport Way LLC, 3200 Danville Boulevard, Suite #200, Alamo, CA 94507; and WHEREAS, the 320 Airport Way Tentative Subdivision Map is a Tentative Map for 116 single-family attached duplexes, located at 320 North Airport Way identified by Assessor’s Parcel Number (APN) 200-140-26; and WHEREAS, the Manteca Planning Commission at their duly noticed public hearing on March 3, 2022, recommended approval to the City Council for the Tentative Subdivision Map; and WHEREAS, the project is found to be consistent with the overall policies of the Manteca General Plan, the Subdivision Map Act, and Manteca Municipal Code as described in the Planning Commission Staff report dated March 3, 2022; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
A Mitigated Negative Declaration was completed for this project, and it was found that, although the proposed project could initially have a significant effect on the environment, mitigation measures have been placed as conditions on the project to reduce those impacts to a less than significant level, eliminating the need for further CEQA review.
3. The City Council hereby adopts, as its own, the findings required to approve the Tentative Subdivision Map under Municipal Code Section 16.09.040, findings for which are detailed in the Planning Commission Staff Report (dated March 3, 2022), which is hereby incorporated by reference into this Resolution as if set forth in full.
4. Based on the foregoing, the City Council hereby approves Tentative Subdivision Map, attached hereto as Exhibit A, subject to all conditions attached hereto as Exhibit B.
5. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 19th day of April, 2022, by the following vote:
