RESOLUTION R20XX-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING THE DECERTIFICATION OF THE CONFIDENTIAL MID-MANAGEMENT ASSOCIATION WHEREAS, the City of Manteca is governed by an Employer-Employee Organization Relations Resolution (EEORR); and WHEREAS, that resolution was approved by Council in 1997; and WHEREAS, on February 9, 2015 the City of Manteca received a Petition for Forma Recognition establishing the formation of the Confidential Mid-Management Employees Association (CMMA); and WHEREAS, the establishment of that unit was approved by Council on April 7, 2015; and WHEREAS, on March 28, 2022 The City received a signed Decertification petition from members of the CMMA; and WHEREAS, on March 29, 2022 the City’s Acting Director of Human Resources reviewed the request for decertification and determined it was filed in compliance with Article II of the EEORR; and WHEREAS, a secret ballot election was held on April 7, 2022; and WHEREAS, no objections were filed with the majority of the votes electing the Manteca Mid-Management Association (MMA) as the exclusive representative of the CMMA; and WHEREAS, the following classifications from CMMA will now be represented by MMA; Assistant City Clerk, Deputy Director Waste Management, Deputy Director Maintenance & Operations, Deputy Director Development Services – Planning, Deputy Director Development Services – Building, Deputy Director Engineering, Deputy Director Water Resources, IT Applications Manager, IT Operations Manager, Revenue Manager and Senior Budget Analyst; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. Approval of the CMMA Decertification.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 3rd day of May, 2022, by the following vote:
