RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AMENDMENT NO. 2 TO THE AGREEMENT WITH NATIONAL EXPRESS TRANSIT TO EXTEND SERVICES FOR ONE ADDITIONAL YEAR AND AUTHORIZING THE CITY MANAGER TO SIGN THE AMENDMENT WHEREAS, on June 6, 2017, the City Council approved and awarded a transit operations contract with National Express Transit to operate the Manteca Transit System and provide transit operations services within the City of Manteca from fiscal year 2018 through 2021, with two, optional, one-year extensions; and WHEREAS, on April 20, 2021, the City Council approved Amendment No. 1 to the agreement with National Express Transit to extend the provision of transit operations services through June 30, 2022, and increase compensation for these services; and WHEREAS, the City’s agreement with National Express Transit will expire on June 30, 2022; and WHEREAS, the parties desire to extend the agreement by exercising the final one-year extension of the agreement as allowed under Section 4 thereof; and WHEREAS, due to current market conditions, an increase in high-demand licensed commercial drivers, a competitive labor market in the transportation sector, and a multi-year operations contract with National Express Transit, Manteca Transit driver wages are not competitive with competing sectors; and WHEREAS, in an effort to provide adequate resources to National Express Transit to recruit and retain high-quality staff to provide services under this agreement, an increase in compensation is also necessary to maintain the current level of services under the parties’ agreement; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council hereby approves Amendment No. 2 to the Professional Services Agreement with National Express Transit, to extend the agreement until June 30, 2023, and increase the compensation due as follows:
a. A fixed monthly rate in the amount of $38,534.00 plus $39.54 per revenue vehicle hour.
b. Compensation for fiscal year 2022/2023 (July 1, 2022 through June 30, 2023) shall not exceed $1,333,255.00,
absent further, written, authorization.
3. The City Manager is authorized to sign Amendment No. 2 to the Agreement.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 3rd day of May, 2022, by the following vote:
