RESOLUTION R22XX-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AUTHORIZING AND APPROVING AMENDMENTS TO THE CONFIDENTIAL EMPLOYEE UNIT MEMORANDUM OF UNDERSTANDING WHEREAS, on January 18, 2022, the City Council for the City of Manteca approved the formation of the “Confidential Employees Unit (“CEU”), as well as the corresponding Memorandum of Understanding (the “MOU”); and WHEREAS, the MOU set the bargaining unit for the “mirror” organization to be the Confidential Mid-Managers Association (“CMMA”) for the following positions (as designated by the City Manager): Assistant City Attorney, Deputy City Attorney, Deputy Director of Finance, and Human Resources Manager; and WHEREAS, on May 3, 2022, the City Council approved the decertification of CMMA, and approved that its members join the Manteca Mid-Management Association (“MMA”) pursuant to Section 7 of the Employer-Employee Organization Relations Resolution. To be effective immediately; and WHEREAS, consistent with the decertification of CMMA, the City Manager has now appointed the above listed positions to be “mirror” to MMA, and brings forward this resolution to the City Council to amend the MOU; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. The following amendments to the MOU are hereby approved by the City Council: the “mirror” bargaining unit for the positions of Assistant City Attorney, Deputy City Attorney, Deputy Director of Finance, and Human Resources Manager shall be the Manteca Mid-Management Association (“MMA”).
3. This resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 17th day of May, 2022, by the following vote:
