RESOLUTION R2022-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, State of California, APPROVING A PROJECT SPECIFIC MAINTENANCE AGREEMENT (10-0H890) WITH CALTRANS FOR THE SR120/MCKINLEY AVENUE INTERCHANGE PROJECT WHEREAS, the City of Manteca (CITY), in cooperation with the California Department of Transportation (Caltrans), and the San Joaquin Council of Governments (SJCOG), proposed to construct a new State Route (SR) 120 / McKinley Ave interchange project (CIP 11034); and WHEREAS, the Project is located along SR120 between Yosemite Ave and Airport Way within the jurisdictional limits of both the City of Manteca and San Joaquin County; and WHEREAS, the California Department of Transportation and the City of Manteca wish to enter into a Project Specific Maintenance Agreement (PSMA) for the SR120/McKinley Ave Interchange Project (E.A. No. 10-0H890) in accordance with Cooperative Agreement 10-481; and WHEREAS, Caltrans will maintain the entire structure of vehicular and pedestrian overcrossings of SR120 below the deck-wearing surface; and WHEREAS, the CITY will maintain the roadway sections, including the traveled way, shoulders, curbs, sidewalks, wall surfaces (including eliminating graffiti), drainage installations, lighting installations and traffic service facilities that may be required for the benefit or control of traffic using the CITY Roadway beneath the undercrossing structure; and WHEREAS, this PSMA may be modified at any time by the mutual consent of the parties hereto, as needed to best accomplish, through STATE and CITY cooperation, the completion of the whole freeway project for the benefit of the people of the STATE and the CITY.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves the Project Specific Maintenance Agreement (PSMA) with the California Department of Transportation for the SR120/McKinley Avenue Interchange Project within the jurisdictional limits of the City of Manteca.
The City Council of the City of Manteca authorizes the Mayor to sign said PSMA.
This Resolution shall take effect immediately upon its adoption.
