RESOLUTION R22XX-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA AUTHORIZING AN APPLICATION TO THE SAN JOAQUIN COUNTY LOCAL AGENCY FORMATION COMMISSION (LAFCo) REGARDING THE ANNEXATION OF THE MACHADO RANCH PROJECT AREA (FILE NO. ANX20-40) WHEREAS, the City Council of the City of Manteca desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Act of 2000, commencing with the Section 56000 of the California government Code, to prezone and annex approximately 183.46 acres of property, which is comprised of 161.19 acres of Project area, 19.11 acres of Non-Development area with 15 inhabited residential lots, and 3.16 acres of existing right-of-way; and WHEREAS, the 161.19 acres of the Project area has an APN number 241-32-018, the Non-Development area of 19.11 acres has the APN numbers of 241-32-005, -006, -007, -008, -009, -011, -012, -013, -014, -015, -021, -023, -027, -028, and -029; and WHEREAS, the legal description for the entire 183.46-acre annexation is attached to this resolution as Exhibit A; and WHEREAS, the Project area, Non-Development area, and right-of-way sites are located at the southern edge of the City of Manteca’s Sphere of Influence (SOI) where development is envisioned to occur in the next five to ten years and development of the project site under the jurisdiction of the City of Manteca is in the best interest of the residents of the City of Manteca; and WHEREAS, the City, as the lead agency for the Project, has prepared an Environmental Impact Report for the project pursuant to and in accordance with the California Environmental Quality Act (CEQA); and WHEREAS, the Environmental Impact Report (EIR) was made available for the statutory 45-day public review period from October 8, 2021 to November 22, 2021, and public comments received were posted and responded to in the Final EIR; and WHEREAS, the EIR identified one or more significant and unavoidable environmental effects of the project, about which the City Council made certain findings regarding these effects per Resolution No. 22___-____ and has adopted a mitigation monitoring and reporting program and a statement of overriding consideration for any impact that may not be reduced to a less than significant level; and WHEREAS, the City Council weighed the evidence presented at this public hearing and in the staff report and accompanying documents, including the Environmental Impact Report with Mitigation Measures and public comments and responses; and WHEREAS, the City of Manteca City Council has authorized initiation of proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, commencing with Section 56000 of the California Government Code, for an amendment to the City of Manteca’s established incorporated City Limits; and WHEREAS, the San Joaquin County Local Agency Formation Commission (LAFCo) is the approving authority for changes to the City’s boundary and Sphere of Influence; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Manteca authorizes the City staff to make an application to LAFCo for annexation of 183.46-acre total annexation area in the form presented with the accompanying staff report for the Machado Ranch Annexation Project File No. ANX20-40.
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. This Resolution shall take effect immediately upon its adoption.
