RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA MAKING FINDINGS APPROVING A GENERAL PLAN AMENDMENT (FILE NO. GPA20-43) AND TENTATIVE SUBDIVISION MAP (FILE NO. SDJ20-44) FOR THE LUMINA AT MACHADO RANCH PROJECT WHEREAS, the City Council of the City of Manteca, at its duly noticed public hearing on June 7, 2022, considered a General Plan Amendment and Tentative Subdivision Map filed by Stephen Miller of Signature Homes, 4670 Willow Road, Suite 200, Pleasanton, CA 94588; and WHEREAS, the Lumina at Machado Ranch project (Project) consists of an Annexation, General Plan Amendment, Pre-Zoning, Planned Development Overlay, and Tentative Map for an 827-unit Planned Development single-family residential subdivision, located at 20329 South Airport Way, identified by Assessor’s Parcel Number (APN) 241-32-18; and WHEREAS, the Manteca Planning Commission, at its duly noticed Public Hearing of April 21, 2022, recommended approval to the City Council for all components of the project, specifically this General Plan Amendment and Tentative Subdivision Map for the Lumina at Machado Ranch Project; and WHEREAS, the proposed General Plan Amendment and Subdivision Map are consistent with the overall policies of the Manteca General Plan, the Manteca General Plan Update, the Subdivision Map Act, and the Manteca Municipal Code as described in the Planning Commission Staff report dated April 21, 2022; and WHEREAS, the City, as the lead agency for the Project, has prepared an Environmental Impact Report for the project pursuant to and in accordance with the California Environmental Quality Act (CEQA); and WHEREAS, the Environmental Impact Report (EIR) was made available for the statutory 45-day public review period from October 8, 2021 to November 22, 2021, and public comments received were posted and responded to in the Final EIR; and WHEREAS, the EIR identified one or more significant and unavoidable environmental effects of the project, concerning which the City Council made certain findings regarding these effects per Resolution No. 22___-____ and adopted a mitigation and monitoring program and a statement of overriding consideration for any impact that may not be reduced to a less than significant level; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
An Environmental Impact Report was prepared for this project, where significant and unavoidable impacts were identified.
The Council approved Resolution No. 22__-___ adopting a mitigation and monitoring program and a statement of overriding consideration for any impacts that may not be reduced to a less than significant level.
The City Council hereby adopts, as its own, the findings required to approve the Tentative Subdivision Map under Municipal Code Section 16.09.040, findings for which are detailed in the Planning Commission Staff Report (dated April 21, 2022), which is hereby incorporated by reference into this Resolution.
The City Council hereby adopts, as its own, the findings required to approve the General Plan Amendment under Municipal Code Section 17.10.200, findings for which are detailed in the Planning Commission Staff Report (dated April 21, 2022), which is hereby incorporated by reference into this Resolution.
Based on the foregoing, the City Council hereby approves the General Plan Amendment, depicted on the map attached hereto as Exhibit A.
Based on the foregoing, the City Council hereby approves the Tentative Subdivision Map, attached hereto as Exhibit B, subject to all conditions attached hereto as Exhibit C.
8. This Resolution shall take effect immediately upon its adoption.
