RESOLUTION R2022-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AN AGREEMENT WITH SAN JOAQUIN COUNTY FOR DIRECT ASSESSMENT CHARGES OF DELINQUET ENFORCEMENT FEES, FINES, AND ABATEMENT COSTS TO BE PLACED ON THE ASSESSMENT ROLLS.
WHEREAS, the City of Manteca Code Enforcement Unit (City) investigates violations of the Manteca Municipal Code and other State and Federal codes related to land use, building, business licensing and operation, health code, and various other non-criminal statutes; and WHEREAS, as part of the City’s enforcement process administrative citations are issued to property owners in an effort to gain voluntary compliance, and if voluntary compliance cannot be obtained the unit abates public nuisances and properties deemed to be a public health or safety hazard; and WHEREAS, the City utilizes several methods to recover abatement costs, fines, and fees linked with enforcement activity; and WHEREAS, approving the San Joaquin County Special Assessment Charge Agreement and certifying the properties and delinquent amounts to be assessed on the San Joaquin County property tax roll of the property owner provides the City an additional means to recover delinquent balances and costs of service; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Manager is hereby authorized to execute the San Joaquin County Special Assessment Charge Agreement and related documents and implement processes related thereto.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 19th day of July, 2022 , by the following vote:
