RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING A GRANT DEED FROM SATWINDER KAUR, AN UNMARRIED WOMAN, AND HARDEEP SINGH, A MARRIED MAN, AS HIS SOLE AND SEPARATE PROPERTY, ALL AS JOINT TENANTS, WHICH WILL GRANT 5,037 SQUARE FEET OF REAL PROPERTY FOR THE WIDENING OF N. AIRPORT WAY ALONG THE 380 N. AIRPORT WAY FRONTAGE, AND 6,173 SQUARE FEET OF REAL PROPERTY FOR THE DRAIN 5 DRAINAGE DITCH ALONG THE SOUTHERN BOUNDARY OF 380 N. AIRPORT WAY WHEREAS, the Yosemite Greens subdivision was conditionally approved with the requirement to acquire right-of-way over 380 N. Airport Way to accommodate the widening of N. Airport Way in accordance with the City’s Public Facilities Implementation Plan; and WHEREAS, DR Horton, the developer of the Yosemite Greens subdivision, worked with the owner of 380 N. Airport Way, Satwinder Kaur, an unmarried woman and Hardeep Singh, a married man, as his sole and separate property, all as joint tenants, to dedicate a twenty-two foot (22’) wide strip of land to the City along their western property boundary to accommodate the widening of N. Airport Way; and WHEREAS, at the City’s direction, DR Horton worked with the property owner of 380 N. Airport Way to dedicate an approximately twenty-five foot (25’) wide strip of land over the northern half of the existing Drain 5 open ditch to accommodate future improvements to the ditch. At the easternmost end of the Drain 5 dedication, the strip of land expands to forty-five feet (45’) wide; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby accepts the Grant Deed from Satwinder Kaur, an unmarried woman, and Hardeep Singh, a married man, as his sole and separate property, all as joint tenants, which will grant 5,037 square feet of real property for the widening of N. Airport Way along 380 N. Airport Way and 6,173 square feet of real property for the Drain 5 Drainage Ditch along the southern boundary of 380 N. Airport Way.
3. The City Clerk is hereby instructed to record this Resolution and the Grant Deed with the San Joaquin County Recorder’s Office.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 19th day of July 2022, by the following vote:
