RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ADOPTING THE REVISED EASTERN SAN JOAQUIN GROUNDWATER SUSTAINABILITY PLAN AND APPENDICES WHEREAS, in August 2014, the California Legislature passed, and in September 2014 the Governor signed, legislation creating the Sustainable Groundwater Management Act (“SGMA”) “to provide local groundwater sustainability agencies with the authority and technical and financial assistance necessary to sustainably manage groundwater” (Wat. Code, § 10720, (d)); and WHEREAS, SGMA requires sustainable management through the development of groundwater sustainability plans (“GSPs”), which can be a single plan developed by one or more groundwater sustainability agency (“GSA”) or multiple coordinated plans within a basin or subbasin (Wat. Code, § 10727); and WHEREAS, SGMA requires a GSA manage groundwater in all basins designated by the Department of Water Resources (“DWR") as a medium or high priority, including the Eastern San Joaquin Subbasin (designated basin number 5-22.01); and WHEREAS, City of Manteca Groundwater Sustainability Agency was formed as a GSA on December 2016 for the purposes of sustainably managing groundwater in the Eastern San Joaquin Subbasin, within its jurisdictional boundaries, pursuant to the requirements of SGMA; and WHEREAS, City of Manteca Groundwater Sustainability Agency has the authority to draft, adopt, and implement a GSP (Wat. Code, § 10725 et seq.); and WHEREAS, the City of Manteca Groundwater Sustainability Agency is a member of the Eastern San Joaquin Groundwater Authority (“ESJGWA”) formed for the purpose of developing a GSP and coordinating sustainable groundwater management in the Eastern San Joaquin Subbasin (Wat. Code, § 10723.6(i)); and WHEREAS, the ESJGWA submitted an Initial Notification to DWR on behalf of its members to jointly develop a GSP for the Eastern San Joaquin Subbasin on February 8, 2017 ; and WHEREAS, the ESJGWA submitted the GSP to DWR in January 2020; and WHEREAS, on November 18, 2021, the ESJGWA received a Consultation Initiation Letter (Letter) from DWR. The Letter identified two potential deficiencies in the Subbasin GSPs which may preclude DWR’s approval, as well as potential corrective actions to address each potential deficiency. The Letter initiated consultation between DWR, the Plan Manager, the ESJGWA, and the Subbasin’s GSAs; and WHEREAS, in response to DWR’s comments, the GSP was revised in June 2022. DWR comments were addressed in a series of technical memoranda appended to the GSP. The revised GSP and appendices are referred to as the “Revised GSP”; and WHERAS, on April 15, 2022, pursuant to California Water Code Section 10728.4, the ESJGWA, on behalf of its member agencies, gave notice that its member GSAs (including the two County of San Joaquin GSAs) intend to adopt the Revised GSP, and pursuant to Water Code 10728.4, no sooner than 90 days from the date of the notice, each of the member GSAs were to hold a public hearing and consider adopting the Revised GSP; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
City of Manteca Groundwater Sustainability Agency hereby approves and adopts the Revised GSP.
City of Manteca Groundwater Sustainability Agency authorizes the ESJGWA, its consultants, and the Plan Manager to take such other actions as may be reasonably necessary to submit the Revised GSP to DWR by July 27, 2022, and implement the purpose of this Resolution.
This Resolution shall take effect immediately upon its adoption.
