AMENDMENT NO. 2
NO. C2017-92 TO THE GOLF TENANT CONTRACT AND LEASE
BETWEEN THE CITY OF MANTECA
AND “CENTRAL GOLF COMPANY.”
This Amendment No. 2 (“Amendment”) to The Golf Tenant Agreement and Lease (“Agreement”) between the City of Manteca and “Central Golf Company,” is made and entered into this ___ day of ________________, 2021, by and between “Central Golf Company” a California corporation (“Tenant”) and the City of Manteca, a municipal corporation (“City”).
RECITALS
On July 31, 2017, the City of Manteca approved an Agreement with Tenant to provide professional golf-operation services at the Manteca Park Golf Course.
City now desires to amend the Agreement to extend the Term Period for the services undertaken by Tenant through January 31, 2023; Tenant represents the necessary skills, staff and experience to satisfactorily provide the Golf Course Operations services in a timely, professional manner; Extending the Term Period will benefit the City allowing time to complete a long term contract extension with appropriate contract revisions; It is in the mutual best interests of the City and Central Golf Company to amend the Agreement to reflect the Term Period extension; and NOW, THEREFORE, the parties hereby agree as follows:
The term of service of Tenant shall be extended through January 31, 2023.
Holding over: In the event Tenant holds over and continues in possession of the premises after expiration of the term, Tenants continued occupancy of the premises shall be considered a month-to-month tenancy and subject to all terms and condition of the contract and lease.
2. Central Golf Company will continue to perform all of its duties, responsibilities, and obligations under the Agreement.
The City hereby consents to continuing the Agreement with Central Golf Company.
4. Except as expressly amended hereby, all the remaining provisions of the Agreement shall remain in full force and effect.
TO EFFECTUATE THIS AGREEMENT, each of the parties has caused this Agreement to be executed by its duly authorized representative as of the date set forth in the introductory paragraph on page 1 above.
