RESOLUTION R2022-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AN AGREEMENT TO DEFER IMPROVEMENTS AT 253 PACIFIC ROAD (APN 222-400-02) IN A FIXED AMOUNT OF $30,000, AND AUTHORIZE THE MAYOR TO SIGN THE AGREEMENT WHEREAS, General Plan Housing Element Policy H-P-27 directs that, “The City shall promote the expeditious processing and approval of residential projects that meet General Plan policies and City regulatory requirements;” and WHEREAS, the owner of 253 Pacific Road has applied for a building permit to remodel a single family dwelling; and WHEREAS, in accordance with the City of Manteca Municipal Code (MMC), Section 15.28.010(A), “the street area adjacent to all premises shall be improved at the expense of the property owner with curbs, gutters, sidewalk and street paving from gutter to existing paving or center of street . . . ;” and WHEREAS, due to the lack of roadway frontage improvements along this portion of Pacific Road, the City Engineer has elected to defer the improvements as allowed by the MMC, Section 15.28.010(B); and WHEREAS, the property owner has agreed to defer the improvements and worked with the City to enter into an agreement granting a lien against the property in an amount equal to the estimated cost of the improvements along the frontage on Pacific Road; and WHEREAS, the owner is responsible for 40 lineal feet of improvements along Pacific Road and the engineer’s estimate for the installed cost of the improvements is $30,000 which is the amount of the lien; and WHEREAS, the property owner has elected to grant a lien on his land in the amount of the improvements which were estimated to be $30,000; and WHEREAS, per the agreement, at the time of construction, the costs will be updated and the property owner will be responsible for the actual cost of improvements along the frontage of the property; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council does hereby approve the Agreement to Defer Improvements at 253 Pacific Road, Manteca, CA.
The City Council does hereby authorize the Mayor to sign the Agreement to Defer Improvements that includes the Grant of Lien.
The City Clerk is hereby instructed to record the Agreement to Defer Improvements that includes the Grant of Lien with the San Joaquin County Recorder’s Office.
This Resolution shall take effect immediately upon its adoption.
