Notes:

1.    See additional standards for small-lot single-family development in Section 17.26.040.

2.    Setbacks shall be at least the minimum required under the City’s adopted Building Code.

3.    When adjacent to a residential district, the minimum front and side yard setbacks for all structures shall be equal to or greater than the front and side yard setbacks of the adjacent residential district. The final approving authority may increase the setback to ensure consistency with performance standards of Chapter 17.58. The required rear yard setback of commercial and industrial structures shall be a minimum of 40 feet when a commercial or industrial zoned parcel shares a property line with an adjacent residentially zoned parcel.

4.    Garages attached to a main building may encroach into the required rear yard by not more than 10 feet if: (a) it is less than 600 square feet in area; and (b) it shares a common wall of 5 feet or more in length, or is located less than 6 feet from the main building and is connected to the main building by a roofed area (e.g., breezeway) a minimum of 5 feet in width.

5.    Minimum 30 percent of multi-family projects shall be designed for community open space and each unit shall include 400 square feet of private open space as described in Section 17.26.030.

6.    The final approving authority, as defined in Table 17.08.060-1, may reduce the minimum setbacks of all structures upon finding that the proposed use complies with the performance standards in Chapter 17.58 and the structure is of a mass and scale that is compatible with adjacent existing uses and structures. In order to do so, the final approving authority must find that the reduced setbacks will not cause an unreason-able impact on the adjacent property. Where the proposed use does not comply with the performance standards in Chapter 17.58, then the final approving authority may impose a condition of approval to increase the minimum setbacks as necessary to ensure the proposed use complies with such performance standards.

SECTION 2: Severability. If any section, sub-section, subdivision, paragraph, clause or phrase in this Ordinance, or any part thereof, is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections or portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, sub-section, subdivision, paragraph, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more sections, sub-sections, subdivisions, paragraphs, sentences, clauses or phrases may be declared invalid or unconstitutional.

SECTION 3: Effective Date. This Ordinance shall become effective thirty (30) days following adoption.
