RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING A GRANT DEED (D- ) FOR AN EMERGENCY VEHICLE ACCESS EASEMENT AT 448 AND 456 EAST ALAMEDA STREET, MANTECA, CA WHEREAS, the Conditions of Approval for the Madan Das Apartment Building required the dedication of an Emergency Vehicle Access (EVA) easement over the twenty-six foot (26’) wide drive aisle and an emergency vehicle turnaround area in accordance with California Fire Code, Section D103.1; and WHEREAS, on the approved plans for the Madan Das Apartment Building, Madan Mohan Das, hereinafter called Developer, dedicated a 13,360 sq. ft. Emergency Vehicle Access and turnaround easement to allow emergency services access onto the property; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council, of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council of the City of Manteca, a Municipal Corporation, does hereby accept the Grant Deed from Madan Mohan Das, a married man, as his sole and separate property, for an Emergency Vehicle Access Easement.
3. The City Clerk is hereby instructed to record this Resolution and associated Grant Deed with the San Joaquin County Recorder’s Office.
3. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of September 2022, by the following vote:
