RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AMENDMENT NO. 1 TO THE IMPROVEMENT AGREEMENT FOR GRIFFIN PARK, UNIT NO 1, MODIFYING SCHEDULE B, TOTAL TRANSPORTATION FACILITIES SYSTEM, PUBLIC FACILITIES IMPLEMENTATION PLAN REIMBURSEMENT, INCREASING THE AMOUNT FROM $304,685.30 TO $353,900.30 WHEREAS, on June 4, 2019, the Griffin Park Tentative Subdivision Map was approved by the Manteca City Council; and WHEREAS, On June 1, 2021, the City Council of the City of Manteca approved the Improvement Agreement and Final Map for Griffin Park Unit No. 1, Tract 4046; and WHEREAS, the Improvement Agreement for Griffin Park Unit 1, Schedule B, identified $304,685.30 for Transportation Facilities System Improvements for Public Facilities Implementation Plan (PFIP) reimbursement; and WHEREAS, the PFIP Transportation Facilities System Improvements included a center median on S. Main Street, but the median did not allow for a southbound left turn onto Rina Drive; and WHEREAS, during construction of the Transportation Facilities System Improvements, City desired to allow for a left turn movement onto Rina Drive for vehicles traveling southbound on S. Main Street; and WHEREAS, construction of the southbound left turn pocket necessitated some already-constructed Transportation Facilities System Improvements to be demolished, additional construction materials to be provided, and changes made to the improvement plans; and WHEREAS, the additional cost to construct the modified Transportation Facilities System Improvements, to allow for a southbound left turn movement onto Rina Drive, was $49,215.00; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council approves an amendment to the Improvement Agreement for Griffin Park, Unit No. 1, modifying Schedule B, Total Transportation Facilities System, Public Facilities Implementation Plan Reimbursement, increasing the amount from $304,685.30 to $353,900.30.
3. The City Council authorizes the Mayor to sign the Amendment.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 4th day of October 2022, by the following vote:
