RESOLUTION R2022-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, State of California, ADOPTING THE AGREEMENT BETWEEN THE cITY OF mANTECA AND Pacific Advanced Civil Engineering, INC. FOR THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE WQCF Capacity Improvements Project CIP 23002, 23003, 23004, 23005, And 17008.
WHEREAS, the City of Manteca (City), intends to complete designs for the WQCF Capacity Improvements Project (Project) (CIP 23002, 23003, 23004, 23005, and 17008); and WHEREAS, the City issued a Request for Proposal (RFP) on August 18, 2022, for the preparation of biddable plans and specifications for the Project; and WHEREAS, responses to all received requests for clarification were published on the City’s website on September 1, 2022; and WHEREAS, two firms submitted responses to the RFP; and
WHEREAS, the evaluation committee consisted of four (4) panel members who evaluated and scored each RFP; and WHEREAS, Pacific Advanced Civil Engineer, Inc. (PACE) was selected as the most responsible, responsive and best-qualified firm to provide Services to the Project; and WHEREAS, Design Services for said project will be primarily funded by COVID Relief funds (American Rescue Plan Act of 2021) and in part by undesignated reserve wastewater funds; and WHEREAS, the Compressed Biogas Fueling Facility project – Phase II (CIP No. 17008) has been in operation since construction completion in 2019, funded in-part by grant funding from the California Energy Commission (CEC), needs to be reopened in order to compile operational data and develop the final report for submittal to the CEC thereby allowing release of retention funds in the amount of $300,400; and WHEREAS, staff requests to appropriate $33,500 from Sewer Maintenance and Operations Fund (Fund 640) Undesignated Reserves to the Account for the Final CEC Report associated with the Compressed Biogas Fueling Facility Project – Phase II (CIP No. 17008); and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
Amend the Capital Improvement Program to reopen the Compressed Biogas Fueling Facility Project – Phase II (CIP No. 17008).
Appropriate $33,500 from Sewer Maintenance and Operations Fund (Fund 640) Undesignated Reserves to the Account for the Compressed Biogas Fueling Facility Project – Phase II (CIP No. 17008).
Authorizes the City Manager or designee to sign the agreement and associated documents between PACE for the WQCF Capacity Improvements Project for an amount not-to-exceed $461,870.
Authorizes the City Manager or designee to, approve project contingencies for an amount not-to-exceed $46,187.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 4th day of October, 2022, by the following vote:
