RESOLUTION R20XX-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING CHANGE ORDER NO. 5 TO THE CONTRACT WITH JHK CONSTRUCTION FOR THE CDBG SENIOR CENTER IMPROVEMENTS – PHASE 2 (CIP 18049 AND 20012) AND ACCEPTING THE PROJECT AS COMPLETE AND AUTHORIZE THE CITY CLERK TO FILE A NOTICE OF COMPLETION WHEREAS, on 15 June 2021, City Council authorized a call for bids for the CDBG Senior Center Improvements – Phase 2 (CIP 18049) and included the Senior Center Refrigeration Upgrades and Renovations Project (CIP 20012) ; and WHEREAS, on 15 June 2021, City Council authorized the City Manager to execute a contract with the lowest responsive bidder with the provision the contract did not exceed available funds. JHK Construction was the lowest responsive bidder with a bid of $891,500; and WHEREAS, on 5 April 2022, City Council authorized Change Order No. 4 for a total change order amount of $281,596.10 for a total revised contract amount of $1,173,096.10; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council does hereby accept the Change Order No. 5 to the contract with JHK Construction, Inc. for the CDGG Senior Center Improvements – Phase 2 (CIP 18049 and 20012) Project increasing the contractor amount by $21,668.32 and authorize the City Manager to sign Change Order No. 5.
The City Council does herby amend the Capital Improvement Plan to increase the total project budget for the CDBG Senior Center Improvements Project (CIP 18049) to $1,102,162.
The City Council does herby appropriate $16,800 from the General Fund Assigned Capital Facilities Reserves (100-3400.04) to the CDBG Senior Center Improvements Project (CIP 18049) Account No. 100.20.25.330-7000.04.
The City Council does herby amend the Capital Improvement Plan to increase the total project budget for the Senior Center Refrigeration Upgrades and Renovations Project (CIP 20012) to $704,200.
The City Council does herby appropriate $239,200 from the General Fund Assigned Capital Facilities Reserves (100-3400.04) to the Senior Center Refrigeration Upgrades and Renovations Project (CIP 20012) Account No. 100.20.25.330-7000.04.
The City Council does herby determine the project has been constructed in the general conformance with the contract plans and specifications for a final cost of $1,194,764.42.
The City Council does herby accept the Notice of Completion for the CDBG Senior Center Improvements – Phase 2 Project (CIP 18049 and 20012) and hereby instructs City Clerk for the City of Manteca, to attend to the proper recordation of same.
9. This Resolution shall take effect on the effective date immediately.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 18th day of October, 2022, by the following vote:
