RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA MAKING FINDINGS APPROVING A TENTATIVE SUBDIVISION MAP FOR THE DUTRA TENTATIVE SUBDIVISION MAP (FILE NO. SDJ21-057) WHEREAS, the City Council of the City of Manteca, at its duly noticed public hearing on October 18, 2022, considered a Tentative Subdivision Map filed by Michael Kiper with KDH Group, LLC, 3200 Danville Boulevard, Suite 200, Alamo, CA 94507; and; and WHEREAS, the Dutra Annexation Project (Project) consists of an Annexation, Pre-Zoning, and Tentative Map for a 197-unit, single-family residential subdivision, identified by Assessor’s Parcel Numbers (APNs) 226-17-008 (portion), 226-17-012, and -013; and WHEREAS, the Manteca Planning Commission, at its duly noticed Public Hearing of September 15, 2022, recommended approval to the City Council for all components of the project, specifically this Tentative Subdivision Map; and WHEREAS, the proposed Tentative Subdivision Map is found to be consistent with the overall policies of the Manteca General Plan, the Manteca General Plan Update, the Subdivision Map Act, and the Manteca Municipal Code as described in the Planning Commission Staff report dated September 15, 2022; and WHEREAS, the City, as the lead agency for the Project, has prepared an Initial Study/Mitigated Negative Declaration (IS/MND) for the project pursuant to and in accordance with the California Environmental Quality Act (CEQA); and WHEREAS, the IS/MND was made available for the statutory 30-day public review period from July 9, 2022 to August 9, 2022, and public comments received were posted and responded to; and WHEREAS, the City Council adopted the IS/MND and a Mitigation Monitoring and Reporting Program with the adoption of Resolution No. 22___-____; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
An Initial Study/Mitigated Negative Declaration was prepared for this project.
The City Council hereby adopts, as its own, the findings required to approve the Tentative Subdivision Map under Municipal Code Section 16.09.040, findings for which are detailed in the Planning Commission Staff Report (dated September 15, 2022), which is hereby incorporated by reference into this Resolution.
Based on the foregoing, the City Council hereby approves the Tentative Subdivision Map, attached hereto as Exhibit “A”, subject to all conditions attached hereto as Exhibit “B”.
5. This Resolution shall take effect immediately upon its adoption.
