RESOLUTION R2022-XX
RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING THE IMPROVEMENT AGREEMENT FOR THE MANTECA MEDICAL BUILDING LOCATED AT 2077 W. YOSEMITE AVENUE, FOR MPVCA MANTECA LLC WHEREAS, MPVCA Manteca LLC (Owner) is constructing a new medical office building at 2077 W. Yosemite Avenue. The 10,510 sf. medical building will house a dialysis clinic and doctors’ offices to provide services for patients with kidney failure and provide training opportunities; and WHEREAS, the offsite improvements on W. Yosemite Avenue and N. Airport Way include street resurfacing and construction of a right turn lane; curb, gutter, and sidewalk; drainage facilities; street lights; utilities; and traffic signal improvements; and WHEREAS, MPVCA Manteca LLC, the owner of the new medical office building at 2077 W. Yosemite Avenue, is seeking to enter into an Improvement Agreement to construct the offsite improvements; and WHEREAS, the Owner has worked with the City to complete the agreement for work in the public right of way and has submitted the required surety bonds in the amounts specified in the Reference Data section of the Improvement Agreement; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council does hereby approve the Improvement Agreement for the Manteca Medical Building located at 2077 W. Yosemite Avenue for MPVCA Manteca LLC.
The City Council does hereby authorize the City Manager of the City of Manteca to sign the Improvement Agreement, on behalf of the City of Manteca, and authorizes the City Clerk to attest thereto and impress the official seal upon the same.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of November 2022, by the following vote:
