RESOLUTION R22XX-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AUTHORIZING AND APPROVING MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE SAN JOAQUIN AREA FLOOD CONTROL AGENCY AND THE CITIES OF STOCKTON AND LATHROP; AND DELEGATING AUTHORITY TO THE CITY MANAGER TO EXECUTE THE MOU AND ANY SUBSEQUENT AMENDMENTS WHEREAS, on December 15, 2022, the San Joaquin Area Flood Control Agency (SJAFCA) executed a Memorandum of Understanding (the “MOU”) related to potential, alternative financing for the Mossdale Tract Area Project; and WHEREAS, the MOU was the result of good faith negotiations between the signatories, including City of Manteca staff; and WHEREAS, the MOU will help ensure the abovementioned project continues to move forward; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City adopts and approves the Memorandum of Understanding as set out herein.
3. The City delegates the authority to the City Manager to execute the MOU and any subsequent amendments.
4. This resolution shall take effect upon execution by all of the signatories to the MOU.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of December, 2022, by the following vote:
