RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, State of California, awarding the contract for the electrical and plumbing work for the F2E/Food Waste Processing Facility mega thor food separator Project (CIP 22032) for $387,762 to TNT Industrial Contractors, authorize the City manager or designee to sign the contract and associated documents AND EXTEND CONTRACT AS NEEDED TO COMPLETE THE PROJECT, approve contract contingency in the amount of 20% ($77,553) for a not-to-exceed contract total of $465,315, appropriate $465,315 to Account No. 660.00.00.900-7000.04, Amend CIP 22032 to include the ADDITIONAL appropriation for a not-to-exceed project total of $1,364,315, and CLOSE CIP 21021, CIP 22054, and CIP 22055.
WHEREAS, the City of Manteca (City), in cooperation with the California’s Department of Resources Recycling and Recovery (CalRecycle), and the San Joaquin County Solid Waste Department (SJCSW), proposed to install a grant funded F2E/Food Waste Processing Facility Mega THOR Food Separator Project (CIP 22032); and WHEREAS, the Project is located inside the SJC Lovelace Transfer Station floor on Lovelace Road between Union Road and Airport Way within the jurisdictional limits of both the City of Manteca and San Joaquin County; and WHEREAS, the City issued an Invitation To Bid (ITB) on September 20, 2022, for the F2E/Food Waste Processing Facility electrical and plumbing work project; the Mega Thor Turbo Food Separator at the Lovelace Transfer Station; and WHEREAS, two firms submitted responses to the ITB and the evaluation team, consisting of four City staff, elected to one firm on October 28, 2022; and WHEREAS, based on received bid proposal and scope of work, TNT Industrial Contractors, Inc. (TNT) was selected as the most responsive and best-qualified firm to meet the specific goals of said Project; and WHEREAS, staff has completed negotiations with TNT to establish a Scope of Services; and WHEREAS, Construction Management and Inspection Services for the F2E/Food Waste Processing Facility electrical and plumbing work project; the Mega Thor Turbo Food Separator at the Lovelace Transfer Station project will be funded by the Solid Waste fund; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
Award the electrical and plumbing work for the F2E/Food Waste Processing Facility Project (CIP 22032) to TNT Industrial Contractors, Inc. for $387,762.
Authorize the City manager or designee to sign the contract and associated documents, and extend contract as needed to complete the project.
Approve contract contingency in the amount of 20% ($77,553) for a not-to-exceed contract total of $465,315 Appropriate $465,315 to the Mega THOR Food Separator Project (CIP 22032) Account No. 660.00.00.900-7000.04 as follows:
$80,589 from CIP 21021 Side Loader Truck #2 and close this project, $23,118 from CIP 22054 Sweeper #1 and close this project, $20,556 from CIP 22055 Sweeper #2 and close this project, $170,526 from 660.40.75.610-6375.12 Commercial Collection Operating Fees Curbside Recycling, and $170,526 from 660.40.75.620-6375.12 Residential Collection Operating Fees Curbside Recycling.
Amend the Capital Improvement Program to increase the total budget of the Mega THOR Food Separator Project (CIP 22032) by $465,315 for a new total project budget of $1,364,315 This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of December, 2022, by the following vote:
