RESOLUTION R2023-XX
Resolution of the city council of the city of Manteca, state of California, FINDING THE PROJECT EXEMPT FROM CEQA AND aDOPTING THE DOWNTOWN MANTECA TRANSIT CENTER CONNECTIVITY AND ENHANCEMENT PLAN WHEREAS, the Manteca Planning Commission at their duly noticed public hearing of January 19, 2023, approved Resolution No. 1620 recommending to the City Council to find the project exempt from CEQA and adoption of the Downtown Manteca Transit Center Connectivity and Enhancement Plan; and WHEREAS, the City Council at their duly noticed public hearing of February 21, 2023, considered the Downtown Manteca Transit Center Connectivity and Enhancement Plan; and WHEREAS, Caltrans awarded a Sustainable Communities planning grant to the City of Manteca to prepare a complete streets capital infrastructure plan to integrate the Transit Center with the historic downtown area; and WHEREAS, the City contracted with CivicWell to prepare the study and to conduct an outreach program with stakeholders and community members; and WHEREAS, during the course of preparation of the plan, multiple stakeholder committee meetings, public workshops, and public outreach events were held to solicit input on the needs of the community, identify the potential solutions, and to discuss recommendations; and WHEREAS, the Downtown Manteca Transit Center Connectivity and Enhancement Plan (Plan) is incorporated herewith and attached as “Exhibit A”; and WHEREAS, Section 15262 Feasibility and Planning Studies of the CEQA Guidelines provides an exemption to the requirement to prepare a negative declaration or environmental impact report for planning and feasibility studies that are not approving, adopting, or funding any described projects in the Plan and the proposed project consists of only the development of the Plan and no improvement projects are approved, adopted, or funded at this time; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.

NOW THEREFORE, BE IT RESOLVED THAT the City Council finds the project exempt from CEQA and adopts the Downtown Manteca Transit Center Connectivity and Enhancement Plan, based on the following findings:

The proposed Plan is exempt from CEQA in accordance with Section 15262 Feasibility and Planning Studies of the CEQA guidelines, in that the Plan is a planning document for future improvement projects, and does not adopt, approve, or fund any specific construction project; rather the Plan only identifies a range of improvements to be considered at a future time; The proposed Plan is consistent with the City’s General Plan in that it utilizes the existing land use designations and growth projections to identify needed circulation infrastructure to meet the needs of current and future users of the roads, facilities, and businesses in the study area. Improvements identified are consistent with circulation policies to maintain levels of service while implementing multi-modal solutions to non-motorized transportation needs, safe routes to school, and other transportation and circulation planning goals and policies; The plan satisfies the terms of the grant application in that it was developed in coordination with the California Department of Transportation (Caltrans), who was the grantor and ensured compliance with the requirements of the grant.

NOW, THEREFORE, BE IT FURTHER RESOLVED, by the City Council of the City of Manteca, as follows:

The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.

This Resolution shall take effect immediately upon its adoption.
