RESOLUTION APPROVING AN AMENDMENT TO THE IMPROVEMENT AGREEMENT FOR THE WACKERLY SUBDIVISION, TRACT 4048, MODIFYING SCHEDULE B, TABLE 1, TRANSPORTATION SYSTEM P.F.I.P. REIMBURSEMENT, INCREASING THE AMOUNT LISTED AS TOTAL TRANSPORATION FACILITIES SYSTEM PFIP REIMBURSMENT FROM $73,217.01 to $121,989.99 WHEREAS, on June 15, 2021, the City of Manteca and Freestone Manteca, LLC, entered into an Improvement Agreement for the Wackerly Subdivision, Tract 4048 (C2022-08) with the Estimated Total Cost of Improvements of $1,957,326.80; and WHEREAS, the Improvement Agreement for Wackerly Subdivision, Tract 4048, Schedule B, actually identified $70,597.99 for Transportation Facilities System Improvements that are eligible for Public Facilities Implementation Plan (PFIP) reimbursement, but the total was listed as $73,217.01; and WHEREAS, that portion of the Wackerly Subdivision improvement plans extending W. Woodward Avenue to S. Airport Way did not include certain necessary Transportation System PFIP improvements; and WHEREAS, the necessary improvements along the W. Woodward Ave. extension were constructed including: street lights, conduit, pull boxes, electrical conductors, an asphalt berm, striping, and an end of sidewalk barricade; and WHEREAS, in light of the previous recitals, the City of Manteca and Freestone Manteca, LLC, desire to amend the Improvement Agreement for the Wackerly Subdivision, Tract 4048 (C2022-08); and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council approves an amendment to the Improvement Agreement for Wackerly Subdivision, Tract 4048, modifying SCHEDULE B, Table 1, Transportation System P.F.I.P. Reimbursement, increasing the Total Transportation Facilities Systems PFIP Reimbursement amount from $73217.01 to $121,989.99.
3. The City Council authorizes the City Manager to sign and take all necessary steps to effectuate the amendment.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 21st day of February 2023, by the following vote:
