RESOLUTION R2023-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, authorizing the City Manager or designee to 1) execute Amendment No 1 to Agreement No. 10-481 with CalTrans District 10 for the State Route 120 and McKinley Avenue Interchange Project; and 2) authorize the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution WHEREAS, On March 3, 2020, City Council approved Resolution R2020-33 authorizing the City Mayor to execute a cooperative agreement between the California Department of Transportation and the City of Manteca for State Route 120 and McKinley Avenue Interchange Project; and WHEREAS, The cooperative agreement provided $12.3 Million in State funding to be allocated towards the construction of the State Route 120 and McKinley Avenue Interchange Project; and WHEREAS, Staff submitted Reimbursement No. 1 in the amount of $867,438 to CalTrans at the end of 2022; and WHEREAS, As CalTrans was processing Reimbursement No. 1, it was brought to the City’s attention that the Project ID assigned by CalTrans and reflected at the top of each page of CalTrans’ Cooperative Agreement, was incorrect; and WHEREAS, The number should be listed as “1012000159” instead of “1012000059”; and WHEREAS, CalTrans requested execution of Amendment No. 1 to Agreement No. 10-481 to fix this clerical error and address potential audit issues; and WHEREAS, Since the error was not caused by the City, CalTrans is continuing to process reimbursements while the Amendment is routed for approval; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby authorize the City Manager or designee to execute Amendment No 1 to Agreement No. 10-481 with CalTrans District 10 for the State Route 120 and McKinley Avenue Interchange Project.
The City Council hereby authorize the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
