ORDINANCE O2023-XX
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AMENDING MANTECA MUNICIPAL CODE TITLE 10 VEHICLES AND TRAFFIC, CHAPTER 10.12 SPEED LIMITS, SECTION 10.12.020 DESIGNATED (SPEED LIMITS ON CERTAIN CITY STREETS) WHEREAS, the California Vehicle Code (CVC) allows local authorities to increase or decrease the posted speed limits by ordinance to appropriate limits as determined by an Engineering and Traffic Survey for Speed Limits (Traffic Survey); and WHEREAS, the Traffic Survey is conducted once every five (5) years by governing municipalities for the purpose of complying with Section 40802(a) of the CVC; and WHEREAS, the Traffic Survey may be extended to every seven (7) years if the arresting officer has successfully completed the training requirements, and the radar device used to measure the speed has been calibrated as specified in Section 40802(c) of the CVC, or every fourteen (14) years if a registered engineer evaluates the section of the highway and determines that no significant changes in roadway or traffic conditions have occurred as specified in Section 40802(c) of the CVC; and WHEREAS, the current Traffic Survey, which was approved on October 15, 2013, is expiring, and it requires a registered engineer to evaluates the current roadway conditions and the newly constructed roadways within City of Manteca; and WHEREAS, the Traffic Survey, as defined in Section 627 of the CVC, must consider the prevailing speeds, collision records, pedestrian and bicycle activity, roadway traffic and roadside conditions not readily apparent to the driver; and WHEREAS, the Traffic Survey dated May 2, 2023, is prepared based on the most current California Manual on Uniform Traffic Control Devices (MUTCD) 2014 Edition Revision 6 and CVC sections 22357 and 22358.6; and WHEREAS, the speed limits in the Traffic Survey dated May 2, 2023 are established at the nearest 5 mph increment of the 85th-percentile speed of free-flowing traffic. In matching existing conditions with the traffic safety needs of the community, engineering judgment may reduce the posted speed limit by 5 mph due to specific factors such as road characteristics, the pace speed, roadside development and environment, pedestrian activity, and collision history; and WHEREAS, for cases in which the nearest 5 mph increment of the 85th- percentile speed would require a rounding up, then the speed limit may be rounded down to the nearest 5 mph increment below the 85th-percentile speed, if no further reduction is used; and WHEREAS, the Traffic Survey dated May 2, 2023 is approved by a Resolution, and is available in the Engineering Department office; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meeting of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
THE CITY COUNCIL OF THE CITY OF MANTECA DOES ORDAIN AS FOLLOWS:
SECTION 1: Amendment. Manteca Municipal Code Section 10.12.020, Designated, is hereby amended to read as follows:

If any section, sub-section, subdivision, paragraph, clause or phrase in this Ordinance, or any part thereof, is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections or portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, sub-section, subdivision, paragraph, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more sections, sub-sections, subdivisions, paragraphs, sentences, clauses or phrases may be declared invalid or unconstitutional.
SECTION 3: Effective Date. This Ordinance shall become effective thirty (30) days following adoption.
