RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING THE SOUTH SAN JOAQUIN IRRIGATION DISTRICT IRRIGATION EASEMENT QUITCLAIM FOR A PORTION OF THE LATERAL Z EASEMENT LOCATED IN THE EXISTING Marino Way RIGHT-OF-WAY ABUTTING THE THOMAS STREET SUBDIVISION WHEREAS, as part of the Thomas Street subdivision development, the developer was required by the South San Joaquin Irrigation District (SSJID) to realign portions of Lateral Z so the lateral is aligned within the subdivision’s roadways; and WHEREAS, as a result of the realignments, there are portions of the existing SSJID Lateral Z easement that are no longer connected to SSJID’s irrigation network; and WHEREAS, the Developer worked with City staff and SSJID to have a portion of the Lateral Z easement quitclaimed to the City; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council hereby accepts the SSJID Irrigation Easement Quitclaim for a Portion of the Lateral Z Easement Located in the Existing Marino Way Right-of-Way abutting the Thomas Street subdivision.
3. The City Clerk is hereby instructed to record the Irrigation Easement Quitclaim with the San Joaquin County Recorder’s Office after the quitclaim deed is signed by the President and Secretary of the SSJID Board of Directors.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 16th day of May, 2023, by the following vote:
