RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING BUDGET AMENDMENTS, APPROPRIATIONS, AND REIMBURSEMENT TO SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS, FOR AN AMOUNT NOT TO EXCEED $350,000, FOR THE AUSTIN ROAD RESURFACING PROJECT, AND AUTHORIZING CITY MANAGER, OR DESIGNEE, TO TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THIS RESOLUTION WHEREAS, the San Joaquin County Department of Public Works (County) is currently in the process of finalizing a project to resurface Austin Road between Louise Avenue and State Route 120, a portion (2,448 LF) being within the Manteca City Limits and thereby the City’s responsibility to maintain; and WHEREAS, in the spirit of cooperation, the County offered to include the City’s segment of Austin Road as a bid alternate in the Project, so long as the City is agreeable to reimbursing the County for the incurred costs; and WHEREAS, this section of Austin Road is definitely in need of the contemplated road repair work, and the City will benefit having reduced construction unit costs due to the economy of scale of this Project; and WHEREAS, the County is the lead agency and responsible for performing all work associated with the Project; and WHEREAS, the City and County will be responsible for actual Project costs for the work within their respective jurisdictions; and WHEREAS, the County’s Contractor will be required to obtain an encroachment permit from the City to perform the work within the City right-of-way; and WHEREAS, for the Project construction, including County design and construction management costs, and contingency, staff is requesting a total not to exceed amount of $350,000; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves budget amendments, appropriations, and reimbursement to San Joaquin County Department of Public Works, for an amount not to exceed $350,000, for the Austin Road Resurfacing Project.
The City Council hereby approves assigning a Fiscal Year 2022-23 Capital Improvement Project number and amending the Fiscal Year 2022-23 Capital Improvement Program to add the Austin Road Resurfacing Project for a total project budget of $350,000.
The City Council hereby approves appropriating $350,000 to Measure K Transportation Pavement Replacement/Improvement (Account No. 440.00.00.900-8150.02).
The City Council hereby authorizes City Manager, or designee, to take all appropriate actions necessary to carry out the purpose and intent of this resolution
6. This Resolution shall take effect immediately upon adoption.
