RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AUTHORIZING CHANGE ORDER NO. 1; ACCEPTING THE WASTEWATER QUALITY CONTROL FACILITY GLYCERIN SYSTEM PROJECT (CIP NO. 22060) AS COMPLETE; AND APPROVING THE RELEASE OF THE RETENTION PAYMENT THIRTY-FIVE DAYS AFTER THE DATE OF ACCEPTANCE WHEREAS, on September 20, 2022, the City Council awarded the Wastewater Quality Control Facility (WQCF) Glycerin Project (CIP 22060) to Conco West, Inc. in the amount of $358,912.78; and WHEREAS, minor additions to glycerin system are added to the project with Change Order No. 1 for ($1,812.78), funded through CIP 22060; and WHEREAS, the WQCF Glycerin System Project has been completed in accordance with the approved plans and all phases of the improvements have been inspected, tested, and completed to the satisfaction of the Public Works Department of the CITY; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves Change Order No. 1.
The City Council hereby finds that the WQCF Glycerin System Project is complete and is hereby accepted.
The City Council authorizes the release of the retention payment thirty-five days after the date of acceptance.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of June, 2023, by the following vote:
