RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, State of California, authorizing the City Manager or designee to 1) execute Amendment No. 1 to the Professional Services Agreement with Pacific Advanced Civil Engineers, Inc., inCREASING THE AMOUNT OF COMPENSATION BY $328,330, MODIFYING THE SCOPE OF SERVICES, AND EXTENDING THE TIME OF PERFORMANCE, for Engineering Services; and 2) apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution WHEREAS, on August 18, 2022, the City of Manteca (City) advertised a Request for Proposals (RFP) for the preparation of biddable plans and specifications for the construction of the 2021 WQCF Capacity Improvements Project (CIP’s 23002, 23003, 23004, 23005, and 17008); and WHEREAS, on October 13, 2022, the City entered into a Professional Services Agreement with Pacific Advanced Civil Engineers, Inc. (PACE) for $461,870 to provide design services for the subject Project; and WHEREAS, as part of the design PACE was asked to review the Aeration Basin as a whole to see where improvements could be made to the existing design; and WHEREAS, several improvements were suggested that deviated from the original project scope; and WHEREAS, the design changes are expected to improve the plants treatment capacity by an estimated 20-40% depending on various environmental factors; and WHEREAS, most importantly the suggested design changes are expected to eliminate the immediate need for the costly sidestream treatment system; and WHEREAS, Amendment No. 1 with PACE includes a contract time extension to December 31, 2025 and $328,330.00 increase to cover estimated design costs; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby authorizes the City Manager or designee to execute Amendment No. 1 to the Professional Services Agreement with Pacific Advanced Civil Engineers, Inc., increasing the amount of compensation by $328,330, modifying the scope of services, and extending the time of performance, for engineering services.
The City Council hereby authorizes the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
