Environmental Clearance
• Mitigated Negative Declaration circulated from April 7, 2023-May 8, 2023. • The Initial Study and Mitigated Negative Declaration (IS/MND) indicated that there could be some significant adverse effects on the environment.
However, there will not be a significant adverse effect in this case because the project has incorporated specific provisions to reduce impacts to a less than significant level and/or the mitigation measures described in the IS/MDN have been added to the project through the certification of the Mitigation Monitoring and Reporting Program and the Conditions of Approval.

Recommendation
Staff recommends the City Council take the following
actions:
1. Adopt the Indelicato Annexation Mitigated Negative Declaration and a Mitigation Monitoring and Reporting Program; and
2. Approve the annexation of the project parcel totaling 40 acres, and authorize application to LAFCo for annexation once the City has finished negotiating the new tax-sharing agreement; and
3. Approve the General Plan Amendment to change the Public Quasi-Public (PQP) land use designation to Low Density Residential LDR; and
4. Waive the first reading of the Ordinance approving the Pre-Zoning designation, and approve the pre-zoning of the parcel to be annexed; and
5. Adopt a Resolution recommending approval of the Indelicato Tentative Subdivision Map.
