RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA MAKING FINDINGS APPROVING A GENERAL PLAN AMENDMENT (FILE NO. GPA23-036) AND TENTATIVE SUBDIVISION MAP FOR THE INDELICATO ANNEXATION PROJECT (FILE NO. SDJ21-106) WHEREAS, the City Council of the City of Manteca, at its duly noticed public hearing on June 20, 2023, considered a General Plan Amendment and Tentative Subdivision Map filed by Michael Kiper with KDH Group, LLC, 3200 Danville Boulevard, Suite 200, Alamo, CA 94507; and; WHEREAS, the Indelicato Annexation Project (Project) consists of an Annexation, General Plan Amendment, Pre-Zoning, and Tentative Map for a 173-unit, single-family residential subdivision, identified by Assessor’s Parcel Numbers (APN) 204-100-52; and WHEREAS, the Manteca Planning Commission, at its duly noticed Public Hearing of June 1, 2023, recommended approval to the City Council for all components of the project, specifically this General Plan Amendment and Tentative Subdivision Map; and WHEREAS, the proposed General Plan Amendment and Tentative Subdivision Map are found to be consistent with the overall policies of the Manteca General Plan, the Manteca General Plan Update, the Subdivision Map Act, and the Manteca Municipal Code as described in the Planning Commission Staff report dated June 1, 2023; and WHEREAS, the City, as the lead agency for the Project, has prepared an Initial Study/Mitigated Negative Declaration (IS/MND) for the project pursuant to and in accordance with the California Environmental Quality Act (CEQA); and WHEREAS, the IS/MND was made available for the statutory 30-day public review period from April 7, 2023 to May 8, 2023, and public comments received were posted and responded to; and WHEREAS, the City Council adopted the IS/MND and a Mitigation Monitoring and Reporting Program with the adoption of Resolution No. R2023-____; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
An Initial Study/Mitigated Negative Declaration was prepared for this project (SCH# 2023040168).
The City Council hereby adopts, as its own, the findings required to approve the General plan Amendment which are detailed in the Planning Commission Staff Report (dated June 1, 2023), which is hereby incorporated by reference into this Resolution, and which the General Plan Amendment is depicted on the map attached hereto as Exhibit “A”.
The City Council hereby adopts, as its own, the findings required to approve the Tentative Subdivision Map under Municipal Code Section 16.09.040, findings for which are detailed in the Planning Commission Staff Report (dated June 1, 2023), which is hereby incorporated by reference into this Resolution.
Based on the foregoing, the City Council hereby approves the Tentative Subdivision Map, attached hereto as Exhibit “B”, subject to all conditions attached hereto as Exhibit “C”.
6. This Resolution shall take effect immediately upon its adoption.
