RESOLUTION R2023-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ADOPTING THE 2020 URBAN WATER MANAGEMENT PLAN WHEREAS, the California Legislature enacted Assembly Bill 797 (Water Code Section 10610 et seq., known as the Urban Water Management Planning Act [Act]) during the 1983-1984 Regular Session, and amended subsequently, which mandates that every supplier providing water for municipal purposes to more than 3,000 customers or supplying more than 3,000 acre feet of water annually, prepare an Urban Water Management Plan (UWMP), the primary objective of which is to plan for the conservation and efficient use of water; and WHEREAS, the Plan shall be periodically reviewed at least once every five years, and that the City of Manteca (City) shall make any amendments or changes to its plan which are indicated by the review; and WHEREAS, the City is an urban supplier of water to over 23,436 customer connections supplying approximately 15,320 acre-feet of potable water annually, and is therefore required to prepare and adopt an UWMP; and WHEREAS, the City has prepared its 2020 UWMP in conformance with the Act as updated, Senate Bill (SB) 610 Water Supply Assessments and SB 221 Written Verifications of Water Supply, and SBx7-7; and WHEREAS, the urban provisions of the Water Conservation Act of 2009, SBx7-7, direct urban retail water suppliers to achieve 20 percent in per capita water use by 2020, and the City demonstrates its compliance with target reduction in its 2020 UWMP; and WHEREAS, the properly notified San Joaquin County, along with interested parties, of the preparation of its UWMP, and coordinated with those agencies for its preparation; and WHEREAS, the City properly noticed the availability, public hearing and adoption of its UWMP, for the purpose of allowing public comment; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City of Manteca 2020 UWMP is hereby adopted and ordered filed with the City Clerk.
Pursuant to Water Code 10610 et seq., the 2020 UWMP shall be implemented by the City in accordance with the schedule laid out in that document.
The Director of Public Works is hereby authorized and directed to file the City of Manteca 2020 UWMP with the California Department of Water Resources within 30 days after adoption.
The Director of Public Works is hereby authorized and directed to deliver the finalized City of Manteca 2020 UWMP to all holders of the public draft of the City of Manteca 2020 UWMP.
The Director of Public Works is hereby authorized and directed to implement the water conservation programs as set forth in the City of Manteca 2020 UWMP, which includes water shortage contingency and drought planning and analysis, and to make recommendations to the City Council regarding necessary procedures, rules, and regulations to carry out effective and equitable water conservation programs.
The Director of Public Works shall recommend to the City Council additional regulations to carry out effective and equitable allocation of water resources.
The Director of Public Works is authorized to make non-substantive changes and finalize the 2020 UWMP.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 18th day of July, 2023, by the following vote:
